11 Mak<strong>in</strong>g it easier for clubs to amalgamate<br />

11.3.5 Restrictions on transferr<strong>in</strong>g gam<strong>in</strong>g mach<strong>in</strong>e entitlements<br />

The Gam<strong>in</strong>g Mach<strong>in</strong>es Act restricts <strong>the</strong> movement <strong>of</strong> gam<strong>in</strong>g mach<strong>in</strong>es by <strong>the</strong> parent<br />

club. These requirements effectively reduce <strong>the</strong> number <strong>of</strong> gam<strong>in</strong>g mach<strong>in</strong>es ano<strong>the</strong>r<br />

club can <strong>of</strong>fer to <strong>the</strong> parent club (or that a parent club can shift to ano<strong>the</strong>r club to<br />

improve its operations). The underly<strong>in</strong>g policy objective <strong>of</strong> <strong>the</strong>se restrictions is both<br />

gambl<strong>in</strong>g harm m<strong>in</strong>imisation and deterrence <strong>of</strong> predatory behaviour by stronger<br />

clubs. These restrictions <strong>in</strong>clude:<br />

A club must forfeit one gam<strong>in</strong>g mach<strong>in</strong>e entitlement for every two to three<br />

gam<strong>in</strong>g mach<strong>in</strong>es it transfers, unless both clubs are located with<strong>in</strong> a certa<strong>in</strong><br />

distance from each o<strong>the</strong>r.<br />

Where a club premises has less than 10 gam<strong>in</strong>g mach<strong>in</strong>e entitlements, none can be<br />

transferred unless approved by <strong>the</strong> majority <strong>of</strong> ord<strong>in</strong>ary members at an<br />

extraord<strong>in</strong>ary general meet<strong>in</strong>g.<br />

The <strong>NSW</strong> Liquor Adm<strong>in</strong>istration Board may require a Social Impact Assessment<br />

(SIA) when transferr<strong>in</strong>g gam<strong>in</strong>g mach<strong>in</strong>e entitlements.<br />

Various stakeholders submitted that <strong>the</strong> current SIA process, limitations on <strong>the</strong><br />

number <strong>of</strong> amalgamations and restrictions on shift<strong>in</strong>g gam<strong>in</strong>g mach<strong>in</strong>e entitlements<br />

are a h<strong>in</strong>drance to amalgamation. 216 <strong>Clubs</strong><strong>NSW</strong> argued that <strong>the</strong> ma<strong>in</strong> impediment to<br />

amalgamation is <strong>the</strong> f<strong>in</strong>ancial dis<strong>in</strong>centives related to gam<strong>in</strong>g mach<strong>in</strong>e<br />

entitlements. 217<br />

The report on <strong>the</strong> review <strong>of</strong> <strong>the</strong> Gam<strong>in</strong>g Mach<strong>in</strong>es Act, released <strong>in</strong> December 2007,<br />

has addressed some <strong>of</strong> <strong>the</strong> above issues <strong>in</strong> its proposals. IPART supports <strong>the</strong> general<br />

direction <strong>of</strong> <strong>the</strong> proposals and <strong>of</strong> <strong>the</strong> <strong>Registered</strong> <strong>Clubs</strong> Amendment Regulation 2007, as<br />

<strong>the</strong>y relate to club amalgamations. This direction <strong>in</strong>cludes:<br />

Relax<strong>in</strong>g <strong>the</strong> restriction on gam<strong>in</strong>g mach<strong>in</strong>e transfers between related clubs by<br />

remov<strong>in</strong>g <strong>the</strong> forfeiture requirement if <strong>the</strong> transfer is with<strong>in</strong> <strong>the</strong> same local<br />

government area (LGA) and chang<strong>in</strong>g <strong>the</strong> forfeiture ratio to one entitlement for<br />

every six for <strong>in</strong>ter-LGA club transfers.<br />

Amend<strong>in</strong>g <strong>the</strong> SIA process (which will be renamed Local Impact Assessment<br />

(LIA)) to change <strong>the</strong> threshold for when it is required, and simplify some <strong>of</strong> <strong>the</strong><br />

steps <strong>in</strong>volved (see Box 11.3).<br />
