And even if we were to assume that the dancer gave it to the singer<br />

<strong>by</strong> throwing it at him, why would everyone else have ownership of it<br />

(they cut the garment to pieces and give each attendee a piece)?<br />

Also, when they take possession of the clothes, they rip them up.<br />

This is not proper behavior for two reasons:<br />

First: <strong>The</strong>y do not own it to do such a thing.<br />

Second· It is a waste of property.<br />

<strong>The</strong>n what is the idea behind giving a piece of cloth to those who<br />

have not attended the dance session?<br />

As for the l:iadith Abu Musa (raeffyAJ/ahu 'anhu), scholars like Al­<br />

Khattabi said: Perhaps Allah's Messenger (li) took permission from<br />

those who have attended the battle to give some of the booty to<br />

those who have not. Or it might have been from the "fifth" that was<br />

the Prophet's (li) right to distribute.<br />

<strong>The</strong>se people are similar to the people of J dhil[Jyah who used their<br />

bad intellect to innovate the system of al-Bal}irah, a/-Sdibah, al- W(J{ilah<br />

and al-Ham.<br />

<strong>Ibn</strong> Tahir -one of their senior scholars- said: "Our scholars have<br />

agreed that rags are to be distributed at the scholars' discretion. <strong>The</strong>y<br />

cited 'Umar's (raeffyA//dhu 'anhu) saying: <strong>The</strong> spoils belongs to those<br />

who have present at the battle.<br />

However, our Shaikh Abu Isma'il al-Anari disagreed. He said:<br />

Poor quality rags are to be distributed among all attendees (of the<br />

singing session). As for sound clothes, they are to be given to the<br />

singer. He cited the l:iadith of Salamah (raeffyAJ/ahu 'anhu) when<br />
