3 request a subsequent EIR on those issues. I think I
4 have so much information.
5 On the water issue can you as our counsel
6 give us any guidance on whether or not you think
7 Ordinance 89 -- and how that would impact this project,
8 if that is enough new information, that it would be a
9 substantial change environmentally. Could you advice us
10 on that.
11 MR. GHIZZONI: Chairman Bierig,
12 Commissioner Burrows, yes, I believe that, if you found
13 that Ordinance 89 -- the combination of Ordinance 89 and
14 the correspondence you received from the Montecito Water
15 District -- if you found that to be both or either
16 substantial changes in the circumstances or new
17 information of substantial importance such that you
18 require a subsequent EIR as to water supply, that that
19 would be a very defensible position for the County and
20 in a comparative basis would be far more defensible than
21 determining that it was not something that required a
22 subsequent EIR.
23 MS. BURROWS: I'll support a subsequent EIR
24 on the issue of water but not on the other two issues.
