MDU environments will provide access to all UNTW pairs connected to the<br />

Bell<strong>South</strong> garden terminal with which it is associated.<br />

2.8.3.2.3 In high-rise environments IATs will be installed in the wiring closet<br />

adjacent to Bell<strong>South</strong>’s distribution and riser cable terminals unless <strong>TC</strong> SYSTEMS<br />

and Bell<strong>South</strong> mutually agree otherwise. Each IAT installed in a wiring<br />

closet will provide access to UNTW pairs at rates set forth in Exhibit A.<br />

2.8.3.2.4 Once the IATs are installed, <strong>TC</strong> SYSTEMS’s employees will have access to the<br />

IAT without the necessity of coordinating such efforts with Bell<strong>South</strong>’s employees<br />

or agents.<br />

2.8.3.2.5 Bell<strong>South</strong>'s provision of IATs shall fulfill Bell<strong>South</strong>'s obligation to provide a SPOI.<br />

2.8.3.2.6 Upon request by Bell<strong>South</strong>, <strong>TC</strong> SYSTEMS will engage in negotiations with<br />

Bell<strong>South</strong> for the purpose of defining mutually agreeable terms, conditions and<br />

charges that grant Bell<strong>South</strong> access to retail customers in MDUs where <strong>TC</strong><br />

SYSTEMS owns the network terminating wire available to serve the retail<br />

customer. The terms and conditions set forth in Subsections 2.8.3.3.11 –<br />

2.8.3.3.14 of this Section shall be incorporated in any agreement negotiated<br />

between Bell<strong>South</strong> and <strong>TC</strong> SYSTEMS for Bell<strong>South</strong>’s access to <strong>TC</strong> SYSTEMS’s<br />

NTW. If the Parties are unable to reach agreement as to such terms, conditions<br />

and charges within sixty (60) days following Bell<strong>South</strong>’s request, then either Party,<br />

at its option, shall petition the Commission for resolution of the disputed terms.<br />

2.8.3.3 Requirements<br />

2.8.3.3.1 Except as noted below, upon request of <strong>TC</strong> SYSTEMS, Bell<strong>South</strong> will provide<br />

access to any IAT in all instances involving UNTW MDU premises, including<br />

garden style MDU complexes.<br />

2.8.3.3.2 Upon receipt of the SI form requesting access to Bell<strong>South</strong>’s UNTW pairs at a<br />

MDU, representatives of both Parties will participate in a meeting at the site of the<br />

requested access. The purpose of the site visit will include discussion of the<br />

procedures for installation and location of the IAT. By request of <strong>TC</strong> SYSTEMS,<br />

an IAT will be installed either adjacent to Bell<strong>South</strong>’s garden terminal,<br />

telecommunications equipment room, or inside each wiring closet. <strong>TC</strong> SYSTEMS<br />

will deliver and connect its central office facilities to the UNTW pairs within the<br />

IAT. <strong>TC</strong> SYSTEMS may access all pairs on an IAT. <strong>TC</strong> SYSTEMS will only<br />

access pairs that are not being utilized to provide service or where the end user has<br />

requested a change in its local service provider to <strong>TC</strong> SYSTEMS. Prior to<br />

connecting <strong>TC</strong> SYSTEMS’s service on a pair previously used by Bell<strong>South</strong>, <strong>TC</strong><br />

SYSTEMS is responsible for ensuring the end user is no longer using Bell<strong>South</strong>’s<br />

service or another CLEC’s service before accessing UNTW pairs.<br />
