SYSTEMS will be responsible for repairing data services. Each Party will be<br />

responsible for maintaining its own equipment.<br />

3.6.3 <strong>TC</strong> SYSTEMS shall inform its end users to direct data problems to <strong>TC</strong><br />

SYSTEMS, unless both voice and data services are impaired, in which event the<br />

end users should call Bell<strong>South</strong>.<br />

3.6.4 Once a Party has isolated a trouble to the other Party’s portion of the Loop, the<br />

Party isolating the trouble shall notify the end user that the trouble is on the other<br />

Party’s portion of the Loop.<br />

3.6.5 In the event that <strong>TC</strong> SYSTEMS's deployment of xDSL on the High Frequency<br />

Spectrum degrades the voice service such that the end user cannot place a call or<br />

the degradation is E911 service affecting, Bell<strong>South</strong> will restore the service to its<br />

original state and <strong>TC</strong> SYSTEMS shall pay for such restoration at the Loop<br />

conditioning rate. . Notwithstanding anything else to the contrary in this<br />

Agreement, when Bell<strong>South</strong> receives a trouble and isolates the trouble to the<br />

physical collocation arrangement belonging to <strong>TC</strong> SYSTEMS, Bell<strong>South</strong> will<br />

notify <strong>TC</strong> SYSTEMS and bill <strong>TC</strong> SYSTEMS the NTF charges as described in<br />

3.1.10 above. Bell<strong>South</strong> will call <strong>TC</strong> SYSTEMS and inform <strong>TC</strong> SYSTEMS of the<br />

trouble in its equipment. <strong>TC</strong> SYSTEMS may initiate the Bell<strong>South</strong> Customer<br />

Wholesale Interconnection Network Services (CWINS) Maintenance Change<br />

Process for CLEC Connecting Facility Assignments (CFA) to restore the data<br />

service.<br />

3.7 Line Splitting<br />

3.7.1 Line Splitting – a competing carrier (<strong>TC</strong> SYSTEMS or data LEC, but not an<br />

incumbent LEC) seeks to provide combined voice and data services on the same<br />

unbundled Loop, or two competing carriers join to provide voice and data<br />

services.<br />

3.7.2 In the event <strong>TC</strong> SYSTEMS provides its own switching, obtains switching from a<br />

third party or <strong>TC</strong> SYSTEMS obtains switching from a separately negotiated<br />

agreement with Bell<strong>South</strong>, <strong>TC</strong> SYSTEMS may engage in line splitting<br />

arrangements with another CLEC using a splitter, provided by <strong>TC</strong> SYSTEMS, in a<br />

Collocation Arrangement at the central office where the Loop terminates into a<br />

distribution frame or its equivalent.<br />

3.7.3 Bell<strong>South</strong> will make all necessary network modifications including providing nondiscriminatory<br />

access to operational support systems necessary for preordering,<br />

ordering, provisioning, maintenance and repair, and billing for Loops used in a<br />

Line Splitting arrangement. This support will be consistent with the support<br />

provided to Bell<strong>South</strong> and any of its affiliates providing advanced services on<br />

Loops.<br />
