technically feasible and will not undermine the ability of other carriers to obtain<br />

access to unbundled Network Elements or to interconnect with Bell<strong>South</strong>’s<br />

network.<br />

4.1.3 Attachment 2 of this Agreement describes the Network Elements that <strong>TC</strong><br />

SYSTEMS and Bell<strong>South</strong> have identified as of the Effective Date of this<br />

Agreement and are not exclusive. Either Party may identify additional or revised<br />

Network Elements as necessary to improve services to end users, to improve<br />

network or service efficiencies or to accommodate changing technologies, or end<br />

user demand. Upon Bell<strong>South</strong>’s offering of a new or revised Network Element,<br />

Bell<strong>South</strong> shall notify <strong>TC</strong> SYSTEMS of the existence of and the technical<br />

characteristics of the new or revised Network Element. Upon <strong>TC</strong> SYSTEMS’s<br />

identification of a new or revised Network Element, it shall make a request for the<br />

Network Element pursuant to Attachment 10 of this Agreement, incorporated<br />

herein by this reference.<br />

4.2 Enhanced Extended Links (EELs)<br />

4.2.1 EELs are combinations of unbundled Loops and unbundled dedicated transport as<br />

defined in this Attachment, together with any facilities, equipment, or functions<br />

necessary to combine those Network Elements. Bell<strong>South</strong> shall provide <strong>TC</strong><br />

SYSTEMS with non-discriminatory access to EELs where the underlying UNEs<br />

are available and in all instances where the requesting carrier meets the eligibility<br />

requirements, if applicable.<br />

4.2.2 High-capacity EELs are combinations of Loop and transport UNEs or commingled<br />

Loop and transport facilities at the DS1 and/or DS3 level as described in 47 CFR<br />

51.318(b). High-capacity EELs must comply with the service eligibility<br />

requirements set forth in 4.2.5 below.<br />

4.2.3 By placing an order for a high-capacity EEL, <strong>TC</strong> SYSTEMS thereby certifies that<br />

the service eligibility criteria set forth herein are met for access to a converted<br />

high-capacity EEL, a new high-capacity EEL, or part of a high-capacity<br />

commingled EEL as a UNE. Bell<strong>South</strong> shall have the right to audit <strong>TC</strong><br />

SYSTEMS’s high-capacity EELs as specified below.<br />

4.2.4 If a high-capacity EEL or Ordinarily Combined Network Element is not readily<br />

available but can be made available through routine network modifications, as<br />

defined by the FCC, <strong>TC</strong> SYSTEMS may request Bell<strong>South</strong> to perform such<br />

routine network modifications. The request may not be used to place fiber. Each<br />

request will be handled as a project on an individual case basis. Bell<strong>South</strong> will<br />

provide a price quote for the request, and upon receipt of authorization by <strong>TC</strong><br />

SYSTEMS, Bell<strong>South</strong> shall perform the routine network modifications.<br />

4.2.5 Service Eligibility Criteria<br />
