environmental hazards or hazardous materials abatement; and arrangements for which<br />

equipment shipping intervals are extraordinary in length. Time for permitting is<br />

included in ordinary or extraordinary conditions construction intervals. The Parties<br />

may mutually agree to renegotiate an alternative provisioning interval or Bell<strong>South</strong><br />

may seek a waiver from the ordered interval from the appropriate Commission.<br />

7.1.2 When <strong>TC</strong> SYSTEMS adds equipment within initial demand parameters that requires<br />

no additional space preparation work on the part of Bell<strong>South</strong>, then no additional<br />

charges or intervals will be imposed by Bell<strong>South</strong> that would cause delay in <strong>TC</strong><br />

SYSTEMS’s operation.<br />

7.2 Joint Planning. Joint planning between Bell<strong>South</strong> and <strong>TC</strong> SYSTEMS will commence<br />

within a maximum of twenty (20) calendar days from Bell<strong>South</strong>'s receipt of a BFFO.<br />

Bell<strong>South</strong> will provide the preliminary design of the Collocation Space and the<br />

equipment configuration requirements as reflected in the Bona Fide Application and<br />

BFFO. The Collocation Space completion interval as already provided for in Section<br />

7.1 will not change.<br />

7.3 Permits. Each Party, its agent(s) or Bell<strong>South</strong> Certified Supplier(s) will file for the<br />

appropriate permits required for the scope of work to be performed by that Party, its<br />

agent(s) or Bell<strong>South</strong> Certified Supplier(s) within ten (10) calendar days of the<br />

completion of the finalized construction design and specifications.<br />

7.4 Acceptance Walkthrough. <strong>TC</strong> SYSTEMS will schedule and complete an acceptance<br />

walkthrough of the Collocation Space with Bell<strong>South</strong> within fifteen (15) calendar days<br />

after the Space Ready Date. In the event <strong>TC</strong> SYSTEMS fails to complete an<br />

acceptance walkthrough within this fifteen (15) day interval, the Collocation Space<br />

shall be deemed accepted by <strong>TC</strong> SYSTEMS on the Space Ready Date. Bell<strong>South</strong> will<br />

correct any deviations to <strong>TC</strong> SYSTEMS’s original or jointly amended design and/or<br />

specification requirements within seven (7) calendar days after the walkthrough, unless<br />

the Parties mutually agree upon a different timeframe.<br />

7.5 Circuit Facility Assignments (CFAs). Unless otherwise specified, Bell<strong>South</strong> will<br />

provide CFAs to <strong>TC</strong> SYSTEMS prior to the applicable provisioning interval set forth<br />

herein (Provisioning Interval) for those Bell<strong>South</strong> Premises in which <strong>TC</strong> SYSTEMS<br />

has physical Collocation Space with no POT bay or with a grand fathered POT bay<br />

provided by Bell<strong>South</strong>. Bell<strong>South</strong> cannot provide CFAs to <strong>TC</strong> SYSTEMS prior to<br />

the Provisioning Interval for those Bell<strong>South</strong> Premises in which <strong>TC</strong> SYSTEMS has<br />

physical Collocation Space with a POT bay provided by <strong>TC</strong> SYSTEMS or virtual<br />

Collocation Space, until <strong>TC</strong> SYSTEMS provides Bell<strong>South</strong> with the following<br />

information:<br />

For physical Collocation Space with an <strong>TC</strong> SYSTEMS-provided POT bay, <strong>TC</strong><br />

SYSTEMS shall provide Bell<strong>South</strong> with a complete layout of the POT panels on<br />

an equipment inventory update (EIU) form, showing locations, speeds, etc.<br />
