environmental hazards or hazardous materials abatement; and arrangements for which
equipment shipping intervals are extraordinary in length. Time for permitting is
included in ordinary or extraordinary conditions construction intervals. The Parties
may mutually agree to renegotiate an alternative provisioning interval or BellSouth
may seek a waiver from the ordered interval from the appropriate Commission.
7.1.2 When TC SYSTEMS adds equipment within initial demand parameters that requires
no additional space preparation work on the part of BellSouth, then no additional
charges or intervals will be imposed by BellSouth that would cause delay in TC
SYSTEMS’s operation.
7.2 Joint Planning. Joint planning between BellSouth and TC SYSTEMS will commence
within a maximum of twenty (20) calendar days from BellSouth's receipt of a BFFO.
BellSouth will provide the preliminary design of the Collocation Space and the
equipment configuration requirements as reflected in the Bona Fide Application and
BFFO. The Collocation Space completion interval as already provided for in Section
7.1 will not change.
7.3 Permits. Each Party, its agent(s) or BellSouth Certified Supplier(s) will file for the
appropriate permits required for the scope of work to be performed by that Party, its
agent(s) or BellSouth Certified Supplier(s) within ten (10) calendar days of the
completion of the finalized construction design and specifications.
7.4 Acceptance Walkthrough. TC SYSTEMS will schedule and complete an acceptance
walkthrough of the Collocation Space with BellSouth within fifteen (15) calendar days
after the Space Ready Date. In the event TC SYSTEMS fails to complete an
acceptance walkthrough within this fifteen (15) day interval, the Collocation Space
shall be deemed accepted by TC SYSTEMS on the Space Ready Date. BellSouth will
correct any deviations to TC SYSTEMS’s original or jointly amended design and/or
specification requirements within seven (7) calendar days after the walkthrough, unless
the Parties mutually agree upon a different timeframe.
7.5 Circuit Facility Assignments (CFAs). Unless otherwise specified, BellSouth will
provide CFAs to TC SYSTEMS prior to the applicable provisioning interval set forth
herein (Provisioning Interval) for those BellSouth Premises in which TC SYSTEMS
has physical Collocation Space with no POT bay or with a grand fathered POT bay
provided by BellSouth. BellSouth cannot provide CFAs to TC SYSTEMS prior to
the Provisioning Interval for those BellSouth Premises in which TC SYSTEMS has
physical Collocation Space with a POT bay provided by TC SYSTEMS or virtual
Collocation Space, until TC SYSTEMS provides BellSouth with the following
information:
For physical Collocation Space with an TC SYSTEMS-provided POT bay, TC
SYSTEMS shall provide BellSouth with a complete layout of the POT panels on
an equipment inventory update (EIU) form, showing locations, speeds, etc.
