11.6 At Bell<strong>South</strong>’s request, <strong>TC</strong> SYSTEMS shall promptly remove from the Bell<strong>South</strong><br />

Premises any employee of <strong>TC</strong> SYSTEMS Bell<strong>South</strong> does not wish to grant access to a<br />

Bell<strong>South</strong> Premises 1) pursuant to any investigation conducted by Bell<strong>South</strong> or 2)<br />

prior to the initiation of an investigation if an employee of <strong>TC</strong> SYSTEMS is found<br />

interfering with the property or personnel of Bell<strong>South</strong> or another collocated<br />

telecommunications carrier, provided that an investigation shall promptly be<br />

commenced by Bell<strong>South</strong>.<br />

11.7 Security Violations. Bell<strong>South</strong> reserves the right to interview <strong>TC</strong> SYSTEMS’s<br />

employees, agents, or suppliers in the event of wrongdoing in or around Bell<strong>South</strong>’s<br />

property or involving Bell<strong>South</strong>’s or another collocated telecommunications carrier’s<br />

property or personnel, provided that Bell<strong>South</strong> shall provide reasonable notice to <strong>TC</strong><br />

SYSTEMS’s Security representative of such interview and arranges for <strong>TC</strong><br />

SYSTEMS’s Security Personnel to participate. <strong>TC</strong> SYSTEMS and its suppliers shall<br />

reasonably cooperate with Bell<strong>South</strong>’s investigation into allegations of wrongdoing or<br />

criminal conduct committed by, witnessed by, or involving <strong>TC</strong> SYSTEMS’s<br />

employees, agents, or suppliers. <strong>TC</strong> SYSTEMS’s security personnel will make<br />

themselves available within a reasonable period of time. Additionally, Bell<strong>South</strong><br />

reserves the right to bill <strong>TC</strong> SYSTEMS for all reasonable costs associated with<br />

investigations involving its employees, agents, or suppliers if it is established and<br />

mutually agreed in good faith that <strong>TC</strong> SYSTEMS’s employees, agents, or suppliers<br />

are responsible for the alleged act. Bell<strong>South</strong> shall bill <strong>TC</strong> SYSTEMS for Bell<strong>South</strong><br />

property, which is stolen or damaged where an investigation determines the culpability<br />

of <strong>TC</strong> SYSTEMS’s employees, agents, or suppliers and where <strong>TC</strong> SYSTEMS agrees,<br />

in good faith, with the results of such investigation. <strong>TC</strong> SYSTEMS shall notify<br />

Bell<strong>South</strong> in writing immediately in the event that <strong>TC</strong> SYSTEMS discovers one of its<br />

employees already working on the Bell<strong>South</strong> Premises is a possible security risk.<br />

Upon request of the other Party, the Party who is the employer shall discipline<br />

consistent with its employment practices, up to and including removal from<br />

Bell<strong>South</strong>’s Premises, any employee found to have violated the security and safety<br />

requirements of this Section. <strong>TC</strong> SYSTEMS shall not hold Bell<strong>South</strong> harmless for<br />

any damages resulting from such removal of its personnel from a Bell<strong>South</strong> Premises.<br />

11.8 Use of Supplies. Unauthorized use of equipment, supplies or other property by<br />

either Party, whether or not used routinely to provide telephone service will be strictly<br />

prohibited and handled appropriately. Costs associated with such unauthorized use<br />

may be charged to the offending Party, as may be all associated investigative costs.<br />

11.9 Use of Official Lines. Except for non-toll calls necessary in the performance of<br />

their work, neither Party shall use the telephones of the other Party on Bell<strong>South</strong>’s<br />

Premises. Charges for unauthorized telephone calls may be charged to the offending<br />

Party, as may be all associated investigative costs.<br />
