Order shall in no event be deemed to apply retroactively prior to the Effective Date<br />

of this Agreement.<br />

14.8 Exclusions from Reciprocal Compensation.<br />

14.8.1 Reciprocal Compensation Traffic shall not include the following types of traffic:<br />

14.8.1.1 Exchange Access Traffic (Switched Access Traffic). Exchange Access Traffic is<br />

defined as telephone calls requiring local transmission or switching services for the<br />

purpose of the origination or termination of non-Local Intrastate IntraLATA,<br />

Intrastate InterLATA, and Interstate InterLATA traffic, with the exception of any<br />

mandatory local calling areas that cross LATA boundaries. If Bell<strong>South</strong> or <strong>TC</strong><br />

SYTEMS is the other Party’s end user’s presubscribed interexchange carrier or if an<br />

end user uses Bell<strong>South</strong> or <strong>TC</strong> SYTEMS as an interexchange carrier on a<br />

101XXXX basis, Bell<strong>South</strong> or <strong>TC</strong> SYTEMS will charge the other Party the<br />

appropriate tariff charges for originating switched access services.<br />

14.8.1.2 Traffic that originates from, or terminates to, a subscriber line that <strong>TC</strong> SYTEMS<br />

provides, where <strong>TC</strong> SYTEMS does not own, lease from a third party or otherwise<br />

provide its own switch(es).<br />

14.8.1.3 To Transit Traffic, as defined in this Attachment of this Agreement. Transit Traffic<br />

does not include traffic originating from or terminating to <strong>TC</strong> SYTEMS customers<br />

utilizing resold Bell<strong>South</strong> services and such traffic should be addressed consistent<br />

with Attachment 1 of this Agreement. Transit Traffic also does not include UNE-P<br />

traffic, which shall be treated consistent with Section 14.8.1.2 above. Transit Traffic<br />

shall be compensated and billed in accordance with Section 19 of this Attachment.<br />

14.9 For the purposes of this Attachment 3, Common (Shared) Transport is defined as<br />

the transport of one Party’s traffic by the other Party over the other Party’s common<br />

(shared) facilities between the other Party’s tandem switch and end office switch<br />

and/or between the other Party’s tandem switches.<br />

14.10 For the purposes of this Attachment 3, Tandem Switching is defined as the function<br />

that establishes a communications path between two switching offices through a<br />

third switching office through the provision of trunk side to trunk side switching.<br />

14.11 For the purposes of this Attachment 3, End Office Switching is defined as the<br />

function that establishes a communications path between the trunk side and line side<br />

of the End Office switch.<br />

14.12 “IP Enabled Services” includes, but is not limited to, services and applications that<br />

rely on internet protocol for all or part of the transmission of a call. IP Enabled<br />

Services could include the digital communications capabilities of increasingly higher<br />

speeds, that use a number of transmission network technologies, and that generally<br />

have in common the use of internet protocol. IP enabled applications could include<br />

capabilities based on higher-level software that can be invoked by the customer or on<br />
