be conducted in accordance with standards prescribed in Section 252 of<br />

the Act.<br />

2.12 Upon agreement to the rates, terms and conditions of a BFR, an<br />

amendment to this Agreement may be required.<br />

3.0 NEW BUSINESS REQUEST<br />

3.1 A New Business Request (NBR) is to be used by <strong>TC</strong> SYSTEMS to make a<br />

request of Bell<strong>South</strong> for a new or modified feature or capability of an<br />

existing product or service, a new product or service that is not deployed<br />

within the Bell<strong>South</strong> network or operations and business support systems,<br />

product delivery process or option, not otherwise subject to the CCP, or a<br />

new or modified service option that was not previously included in this<br />

Agreement (Requested Enhanced Services).<br />

3.2 An NBR shall be submitted in writing by <strong>TC</strong> SYSTEMS and shall<br />

specifically identify the requesting party (<strong>TC</strong> SYSTEMS SPOC), the<br />

requested service date, technical requirements, space requirements and/or<br />

such specifications that clearly define the request such that Bell<strong>South</strong> has<br />

sufficient information to analyze and prepare a response. The request<br />

shall be sent to <strong>TC</strong> SYSTEMS’s designated Bell<strong>South</strong> Sales contact.<br />

3.3 If Bell<strong>South</strong> determines that the preliminary analysis of the NBR is of<br />

such complexity that it will cause Bell<strong>South</strong> to expend inordinate<br />

resources to evaluate the NBR, Bell<strong>South</strong> will notify <strong>TC</strong> SYSTEMS<br />

within ten (10) business days of Bell<strong>South</strong>’s receipt of the NBR that a fee<br />

will be required prior to the evaluation of the NBR. Bell<strong>South</strong> will provide<br />

<strong>TC</strong> SYSTEMS a report as to why the funds are needed and the types of<br />

resources that will be needed in order to evaluate the NBR. The evaluation<br />

performed by Bell<strong>South</strong> and provided to <strong>TC</strong> SYSTEMS will include a<br />

detailed breakdown of the cost supporting the proposed fee, including the<br />

development costs to complete the preliminary analysis <strong>TC</strong> SYSTEMS<br />

shall submit such fee within thirty (30) business days of Bell<strong>South</strong>’s<br />

notice that a fee is required. Within thirty (30) business days of<br />

Bell<strong>South</strong>’s receipt of the fee, Bell<strong>South</strong> shall respond to <strong>TC</strong> SYSTEMS<br />

by providing a preliminary analysis of such Requested Services that are<br />

the subject of the NBR.<br />

3.4 Within two (2) business days of receipt of a NBR, Bell<strong>South</strong> shall<br />

acknowledge in writing to the <strong>TC</strong> SYSTEMS SPOC its receipt of the<br />

request and identify its single point of contact (Bell<strong>South</strong> SPOC)<br />

responsible for responding to the request and shall request any additional<br />

information needed to process the request. Notwithstanding the foregoing,<br />

Bell<strong>South</strong> may reasonably request additional information from <strong>TC</strong><br />
