is not offering xDSL services to the customer on that Loop. Bell<strong>South</strong> is not<br />

required to condition a Loop for access to the High Frequency Spectrum if<br />

conditioning significantly degrades Bell<strong>South</strong>’s voice service. Should Bell<strong>South</strong><br />

refuse to condition a Loop because it will significantly degrade voiceband services,<br />

Bell<strong>South</strong> must make an affirmative showing to the state commission that<br />

conditioning the specific Loop in question will significantly degrade the voiceband<br />

service. The state commission will determine on a case-by-case basis whether or<br />

not a specific Loop will significantly degrade the voice service on that Loop.<br />

3.1.9 Line Sharing shall only be available on Loops on which Bell<strong>South</strong> is also<br />

providing, and continues to provide, analog voice service directly to the end user.<br />

In the event the end user terminates its Bell<strong>South</strong> provided voice service for any<br />

reason, or in the event Bell<strong>South</strong> disconnects the end user’s voice service pursuant<br />

to its tariffs or applicable law, and <strong>TC</strong> SYSTEMS desires to continue providing<br />

xDSL service on such Loop, <strong>TC</strong> SYSTEMS shall be required to purchase a full<br />

stand-alone Loop UNE. To the extent commercially practicable, Bell<strong>South</strong> shall<br />

give <strong>TC</strong> SYSTEMS notice in a reasonable time prior to disconnect, which notice<br />

shall give <strong>TC</strong> SYSTEMS an adequate opportunity to notify Bell<strong>South</strong> of its intent<br />

to purchase such Loop. In those cases in which Bell<strong>South</strong> no longer provides<br />

voice service to the end user and <strong>TC</strong> SYSTEMS purchases the full stand-alone<br />

Loop, <strong>TC</strong> SYSTEMS may elect the type of Loop it will purchase. <strong>TC</strong> SYSTEMS<br />

will pay the appropriate recurring and nonrecurring rates for such Loop as set<br />

forth in Exhibit A to this Attachment. In the event <strong>TC</strong> SYSTEMS purchases a<br />

voice grade Loop, <strong>TC</strong> SYSTEMS acknowledges that such Loop may not remain<br />

xDSL compatible.<br />

3.1.10 If <strong>TC</strong> SYSTEMS reports a trouble on the High Frequency Spectrum of a Loop<br />

and no trouble actually exists on the Bell<strong>South</strong> portion, Bell<strong>South</strong> will charge <strong>TC</strong><br />

SYSTEMS for any dispatching and testing (both inside and outside the CO)<br />

required by Bell<strong>South</strong> in order to confirm the working status. The rates charged<br />

for no trouble found (NTF) shall be as set forth in Exhibit A of this Attachment.<br />

3.1.11 Only one CLEC shall be permitted access to the High Frequency Spectrum of any<br />

particular Loop.<br />

3.2 Provisioning of Line Sharing and Splitter Space<br />

3.2.1 Bell<strong>South</strong> will provide <strong>TC</strong> SYSTEMS with access to the High Frequency<br />

Spectrum as follows:<br />

3.2.1.1 To order High Frequency Spectrum on a particular Loop, <strong>TC</strong> SYSTEMS must<br />

have a Digital Subscriber Line Access Multiplexer (DSLAM) collocated in the<br />

central office or other network location that can serve the end user of such Loop.<br />
