provided by <strong>TC</strong> SYSTEMS for purposes of such audit shall be deemed<br />

Confidential Information pursuant to the General Terms and Conditions of this<br />

Agreement.<br />

4.2 Subject to Exhibit A hereto, resold services can only be used in the same manner<br />

as specified in Bell<strong>South</strong>’s Tariffs. Resold services are subject to the same terms<br />

and conditions as are specified for such services when furnished to an individual<br />

End User of Bell<strong>South</strong> in the appropriate section of Bell<strong>South</strong>’s Tariffs. Specific<br />

tariff features (e.g. a usage allowance per month) shall not be aggregated across<br />

multiple resold services.<br />

4.3 <strong>TC</strong> SYSTEMS may resell services within the service area as authorized by its<br />

certificate of operation approved by the Commission.<br />

4.4 If <strong>TC</strong> SYSTEMS cancels an order for resold services, any costs incurred by<br />

Bell<strong>South</strong> in conjunction with provisioning of such order will be recovered in<br />

accordance with Bell<strong>South</strong>’s General Subscriber Services Tariffs and Private Line<br />

Services Tariffs.<br />

4.5 Service Jointly Provisioned with an Independent Company or Competitive<br />

Local Exchange Company Areas<br />

4.5.1 When <strong>TC</strong> SYSTEMS resells a Bell<strong>South</strong> private line service that Bell<strong>South</strong> is<br />

jointly provisioning with an ICO, the parties agree that the discount is not<br />

applicable on the ICO portion of the service.<br />

5. Maintenance of Services<br />

5.1 Services resold pursuant to this Attachment and Bell<strong>South</strong>’s General Subscriber<br />

Service Tariff and Private Line Service Tariff and facilities and equipment provided<br />

by Bell<strong>South</strong> shall be maintained by Bell<strong>South</strong>.<br />

5.2 <strong>TC</strong> SYSTEMS or its End Users may not rearrange, move, disconnect, remove or<br />

attempt to repair any facilities owned by Bell<strong>South</strong> except with the written consent<br />

of Bell<strong>South</strong>.<br />

5.3 <strong>TC</strong> SYSTEMS accepts responsibility to notify Bell<strong>South</strong> of situations that arise<br />

that may result in a service problem.<br />

5.4 <strong>TC</strong> SYSTEMS will contact the appropriate repair centers in accordance with<br />

procedures established by Bell<strong>South</strong>.<br />

5.5 For all repair requests, <strong>TC</strong> SYSTEMS shall adhere to Bell<strong>South</strong>'s prescreening<br />

guidelines prior to referring the trouble to Bell<strong>South</strong>.<br />

5.6 Bell<strong>South</strong> will bill <strong>TC</strong> SYSTEMS for handling troubles that are found not to be in<br />

Bell<strong>South</strong>'s network pursuant to its standard time and material charges. The<br />
