Service Tariff. For bills rendered by <strong>TC</strong> SYSTEMS for payment by<br />

Bell<strong>South</strong> the late payment charge shall be calculated based on the portion of<br />

the payment not received by the payment date times the lesser of (i) one and<br />

one-half percent (1½ %) per month or (ii) the highest interest rate (in decimal<br />

value) which may be charged by law for commercial transactions,<br />

compounded daily for the number of days from the payment date to and<br />

including the date that payment is actually made. In no event, however, shall<br />

interest be assessed by <strong>TC</strong> SYSTEMS on any previously assessed late<br />

payment charges. Bell<strong>South</strong> shall only assess interest on previously assessed<br />

late payment charges in a state where it has the authority pursuant to its tariffs.<br />

Bill disputes shall not be submitted by either party for any charge on or after<br />

one (1) year following the bill date of the bill on which the charge first<br />

appears.<br />

1.14 Discontinuance of Service<br />

1.14.1 The procedures for discontinuing service to an end user are as follows:<br />

1.14.1.1 Where possible, Bell<strong>South</strong> will deny service to <strong>TC</strong> SYSTEMS's end user on<br />

behalf of, and at the request of, <strong>TC</strong> SYSTEMS. Upon restoration of the end<br />

user's service, restoral charges will apply and will be the responsibility of <strong>TC</strong><br />

SYSTEMS.<br />

1.14.1.2 At the request of <strong>TC</strong> SYSTEMS, Bell<strong>South</strong> will disconnect an <strong>TC</strong> SYSTEMS<br />

end user.<br />

1.14.1.3 All requests by <strong>TC</strong> SYSTEMS for denial or disconnection of an end user for<br />

nonpayment must be in writing.<br />

1.14.1.4 <strong>TC</strong> SYSTEMS will be made solely responsible for notifying the end user of<br />

the proposed disconnection of the service.<br />

1.14.1.5 Bell<strong>South</strong> may disconnect and reuse facilities when the facility is in a denied<br />

state and Bell<strong>South</strong> has received an order to establish new service or transfer<br />

of service from an end user or an end user’s CLEC at the same address served<br />

by the denied facility.<br />

1.14.2 The procedures for discontinuing service by either <strong>TC</strong> SYSTEMS or<br />

Bell<strong>South</strong> are as follows:<br />

1.14.2.1 The Parties reserve the right to suspend or terminate service for nonpayment<br />

of undisputed amounts or in the event of prohibited, unlawful or improper use<br />

of the each party’s facilities or services, or abuse of the other party’s facilities.<br />
