1.0 The Parties agree that <strong>TC</strong> SYSTEMS is entitled to order any Unbundled<br />

Network Element, Interconnection option, service option or Resale<br />

Service required to be made available by FCC or Commission<br />

requirements pursuant to the Communications Act of 1934, as modified by<br />

the Telecommunications Act of 1996 (the “Act”). <strong>TC</strong> SYSTEMS also<br />

shall be permitted to request the development of new or revised facilities<br />

or service options, which are not required by the Act. Procedures<br />

applicable to requesting the addition of such facilities or service options<br />

are specified in this Attachment 10.<br />

2.0 BONA FIDE REQUEST<br />

2.1 A Bona Fide Request (BFR) is to be used when <strong>TC</strong> SYSTEMS makes a<br />

request of Bell<strong>South</strong> to provide a new or modified Unbundled Network<br />

Element, Interconnection option, product delivery process or option, not<br />

otherwise subject to the CCP, or other service option (Requested Services)<br />

pursuant to the Act that was not previously included in this Agreement.<br />

2.2 A BFR shall be submitted in writing by <strong>TC</strong> SYSTEMS and shall<br />

specifically identify the requesting party (<strong>TC</strong> SYSTEMS SPOC), the<br />

requested service date, technical requirements, space requirements and/or<br />

such other specifications that clearly define the request such that<br />

Bell<strong>South</strong> has sufficient information to analyze and prepare a response.<br />

Such a request shall also include <strong>TC</strong> SYSTEMS’s designation of the<br />

request as being pursuant to the Telecommunications Act of 1996 (i.e. a<br />

BFR). The request shall be sent to <strong>TC</strong> SYSTEMS’s designated Bell<strong>South</strong><br />

Sales contact.<br />

2.3 If Bell<strong>South</strong> determines that the preliminary analysis of the BFR is of such<br />

complexity that it will cause Bell<strong>South</strong> to expend inordinate resources to<br />

evaluate the BFR, Bell<strong>South</strong> will notify <strong>TC</strong> SYSTEMS within ten (10)<br />

business days of Bell<strong>South</strong>’s receipt of the BFR that a fee will be required<br />

prior to the evaluation of the BFR. Such fee shall be limited to Bell<strong>South</strong>’s<br />

extraordinary expenses directly related to the complex request that<br />

required the allocation and engagement of additional resources above the<br />

existing allocated resources used on BFR cost development which include,<br />

but are not limited to, expenditure of funds to develop feasibility studies,<br />

specific resources that are required to determine request requirements<br />

(such as operation support system analysts, technical managers, software<br />

developers), software impact analysis by specific software developers;<br />
