SYSTEMS for any dispatching and testing (both inside and outside the Central<br />

Office (CO)) required by Bell<strong>South</strong> in order to confirm the working status. <strong>TC</strong><br />

SYSTEMS is not obligated to pay for the dispatch if a subsequent (within 10 days<br />

of original trouble) new trouble ticket addressing the same condition is opened and<br />

trouble is found on Bell<strong>South</strong>’s network and corrected.<br />

1.10 For information regarding Ordering Guidelines and Processes for various Network<br />

Elements, Combinations and Other Services, <strong>TC</strong> SYSTEMS should refer to the<br />

"Guides" section of the Bell<strong>South</strong> Interconnection Web site.<br />

1.10.1 Additional information may also be found in the individual CLEC Information<br />

Packages located at the "CLEC UNE Products" on Bell<strong>South</strong>'s Interconnection<br />

Web site at: www.interconnection.bellsouth.com/guides/html/unes.html.<br />

1.11 Rates<br />

1.11.1 The prices that <strong>TC</strong> SYSTEMS shall pay to Bell<strong>South</strong> for Network Elements and<br />

Other Services are set forth in Exhibit A to this Attachment. If, at its option, <strong>TC</strong><br />

SYSTEMS purchases a service(s) from a tariff, all terms and conditions and rates<br />

as set forth in such tariff shall apply.<br />

1.11.2 Rates, terms and conditions for order cancellation charges and Service Date<br />

Advancement Charges will apply in accordance with Attachment 6 and are<br />

incorporated herein by this reference.<br />

1.11.3 If <strong>TC</strong> SYSTEMS modifies an order (Order Modification Charge (OMC)) after<br />

being sent a Firm Order Confirmation (FOC) from Bell<strong>South</strong>, any costs incurred<br />

by Bell<strong>South</strong>, to accommodate the modification, will be paid by <strong>TC</strong> SYSTEMS in<br />

accordance with FCC No. 1 Tariff, Section 5.<br />

1.11.4 Fractionalized billing shall apply to all Network Elements and Combinations such<br />

that recurring charges will be prorated based upon the number of days that the<br />

Network Elements or Combinations are in service. Non-recurring charges shall<br />

not be fractionalized.<br />

2 Unbundled Loops<br />

2.1 General<br />

2.1.1 Bell<strong>South</strong> shall provide <strong>TC</strong> SYSTEMS with nondiscriminatory access to the local<br />

Loop on an unbundled basis, in accordance with section 251 (c) (3) of the Act as<br />

set forth in 47 CFR 51.319 (a)(1) through (a)(9). The local Loop network element<br />

is defined as a transmission facility between a distribution frame (or its equivalent)<br />

in an incumbent LEC central office and the Loop demarcation point at an end user<br />

customer premises. This element includes all features, functions, and capabilities<br />
