11.10 Accountability. Full compliance with the Security requirements of this Section shall in<br />

no way limit the accountability of either Party to the other for the improper actions of<br />

its employees.<br />

11.11 Bell<strong>South</strong> shall not use any information it collects in the course of implementing or<br />

operating security arrangements or other activities for marketing or any other purpose.<br />

11.12 Bell<strong>South</strong> shall exercise the same level of care it provides to itself to prevent harm or<br />

damage to <strong>TC</strong> SYSTEMS, its employees, agents or end users, or their property.<br />

Bell<strong>South</strong> agrees to take reasonable and prudent steps to ensure the adequate<br />

protection of <strong>TC</strong> SYSTEMS property located within Bell<strong>South</strong> Premises including,<br />

but not limited to:<br />

11.12.1 Where <strong>TC</strong> SYSTEMS’s equipment is in a separate caged space, not allowing the same<br />

code or key that opens the external doors to the collocation space to also operate the<br />

doors to <strong>TC</strong> SYSTEMS’s collocation cage.<br />

11.12.2 Ensure that the Central Office that houses <strong>TC</strong> SYSTEMS’s equipment where <strong>TC</strong><br />

SYSTEMS has provisioned Collocation Space is monitored to prevent unauthorized<br />

entry.<br />

11.12.3 Assuring that the physical security and the means of ingress and admission to spaces<br />

that house <strong>TC</strong> SYSTEMS equipment or equipment enclosures are equal to or exceed<br />

those provided for Bell<strong>South</strong> pursuant to Bell<strong>South</strong> admissions practices.<br />

11.12.4 Installing security studs in the hinge plates of doors having exposed hinges with<br />

removable pins if such leads to spaces that contain or house <strong>TC</strong> SYSTEMS equipment<br />

or equipment enclosures.<br />

11.12.5 Controlling access from passenger and freight elevators by continuous surveillance or<br />

by installing security partitions, security grills, locked gates or doors between elevator<br />

lobbies and spaces that contain or house <strong>TC</strong> SYSTEMS equipment or equipment<br />

enclosures.<br />

11.12.6 Bell<strong>South</strong> will provide notification to designated personnel of an actual or attempted<br />

security breach of <strong>TC</strong> SYSTEMS’s Collocation Space, upon Bell<strong>South</strong> discovery of<br />

such breach.<br />

12. Destruction of Collocation Space<br />

12.1 In the event a Collocation Space is wholly or partially damaged by fire, windstorm,<br />

tornado, flood or by similar causes to such an extent as to be rendered wholly<br />

unsuitable for <strong>TC</strong> SYSTEMS’s permitted use hereunder, then either Party may elect<br />

within ten (10) calendar days after such damage, to terminate occupancy of the<br />

damaged Collocation Space, and if either Party shall so elect, by giving the other<br />

written notice of termination, both Parties shall stand released of and from further<br />

liability under the terms hereof. If the Collocation Space shall suffer only minor<br />
