required to connect the structure (i.e., racking, conduits, etc.) to the Bell<strong>South</strong> point<br />

of demarcation. At <strong>TC</strong> SYSTEMS’s option, and where the local authority having<br />

jurisdiction permits, Bell<strong>South</strong> shall provide an AC power source and access to<br />

physical collocation services and facilities, subject to the same nondiscriminatory<br />

requirements as those applicable to any other physical collocation arrangement.<br />

Where <strong>TC</strong> SYSTEMS has elected to construct the adjacent enclosure itself, Bell<strong>South</strong><br />

shall deliver to <strong>TC</strong> SYSTEMS the requested ground space thirty (30) days after<br />

Bell<strong>South</strong> receives <strong>TC</strong> SYSTEMS’s Bona Fide Firm Order, unless Bell<strong>South</strong> requests<br />

an extension of that time, which <strong>TC</strong> SYSTEMS will not unreasonably withhold.<br />

Bell<strong>South</strong> will provide DC power in an adjacent enclosure provided that such<br />

provisioning can be done in compliance with all applicable national electrical and<br />

safety code or any local codes, such as but not limited to zoning codes, provided that<br />

Bell<strong>South</strong> and <strong>TC</strong> SYSTEMS can agree upon a reasonable price for the provision of<br />

this service, and provided that Bell<strong>South</strong> and <strong>TC</strong> SYSTEMS can negotiate a<br />

reasonable provisioning interval.<br />

3.5.4 If physical collocation space becomes available in a previously exhausted Bell<strong>South</strong><br />

structure, Bell<strong>South</strong> must not require <strong>TC</strong> SYSTEMS to move or prohibit <strong>TC</strong><br />

SYSTEMS from moving, a collocation arrangement into that structure in accordance<br />

with the rates terms and conditions of this Attachment. Instead, Bell<strong>South</strong> must<br />

continue to allow <strong>TC</strong> SYSTEMS to collocate in any adjacent controlled environmental<br />

vault, or similar structure that <strong>TC</strong> SYSTEMS has constructed or otherwise procured<br />

unless otherwise agreed to by the Parties or as ordered by a Commission.<br />

3.6 Direct Connect. Bell<strong>South</strong> will permit <strong>TC</strong> SYSTEMS to directly interconnect<br />

between its own virtual/physical Collocation Space within the same central office by<br />

utilizing a Direct Connect. <strong>TC</strong> SYSTEMS shall contract with a Bell<strong>South</strong> Certified<br />

Supplier to place the Direct Connect, which shall be provisioned using facilities owned<br />

by <strong>TC</strong> SYSTEMS. <strong>TC</strong> SYSTEMS-provisioned DC’s shall utilize Bell<strong>South</strong> common<br />

cable support structure. There will be a recurring charge per linear foot, per cable of<br />

the actual common cable support structure used by <strong>TC</strong> SYSTEMS to provision the<br />

Direct Connects between its virtual/physical Collocation Spaces. In those instances<br />

where <strong>TC</strong> SYSTEMS’s virtual/physical Collocation Space is contiguous in the central<br />

office, <strong>TC</strong> SYSTEMS will have the option of using <strong>TC</strong> SYSTEMS’s own technicians<br />

to deploy the Direct Connects using either electrical or optical facilities between its<br />

Collocation Spaces by constructing its own dedicated cable support structure. <strong>TC</strong><br />

SYSTEMS will deploy such electrical or optical connections directly between its own<br />

facilities without being routed through Bell<strong>South</strong>’s equipment. <strong>TC</strong> SYSTEMS may<br />

not self-provision Direct Connects on any Bell<strong>South</strong> distribution frame, POT, DSX<br />

(Digital System Cross-Connect) or LGX (Light Guide Cross-Connect). <strong>TC</strong><br />

SYSTEMS is responsible for ensuring the integrity of the signal.<br />

To place an order for Direct Connects, <strong>TC</strong> SYSTEMS must submit an Initial<br />

Application or Subsequent Application. Fees associated with Direct Connect<br />

applications, if any, are addressed in Sections 6.2 and 6.3.1 of this Attachment.<br />
