required to connect the structure (i.e., racking, conduits, etc.) to the BellSouth point
of demarcation. At TC SYSTEMS’s option, and where the local authority having
jurisdiction permits, BellSouth shall provide an AC power source and access to
physical collocation services and facilities, subject to the same nondiscriminatory
requirements as those applicable to any other physical collocation arrangement.
Where TC SYSTEMS has elected to construct the adjacent enclosure itself, BellSouth
shall deliver to TC SYSTEMS the requested ground space thirty (30) days after
BellSouth receives TC SYSTEMS’s Bona Fide Firm Order, unless BellSouth requests
an extension of that time, which TC SYSTEMS will not unreasonably withhold.
BellSouth will provide DC power in an adjacent enclosure provided that such
provisioning can be done in compliance with all applicable national electrical and
safety code or any local codes, such as but not limited to zoning codes, provided that
BellSouth and TC SYSTEMS can agree upon a reasonable price for the provision of
this service, and provided that BellSouth and TC SYSTEMS can negotiate a
reasonable provisioning interval.
3.5.4 If physical collocation space becomes available in a previously exhausted BellSouth
structure, BellSouth must not require TC SYSTEMS to move or prohibit TC
SYSTEMS from moving, a collocation arrangement into that structure in accordance
with the rates terms and conditions of this Attachment. Instead, BellSouth must
continue to allow TC SYSTEMS to collocate in any adjacent controlled environmental
vault, or similar structure that TC SYSTEMS has constructed or otherwise procured
unless otherwise agreed to by the Parties or as ordered by a Commission.
3.6 Direct Connect. BellSouth will permit TC SYSTEMS to directly interconnect
between its own virtual/physical Collocation Space within the same central office by
utilizing a Direct Connect. TC SYSTEMS shall contract with a BellSouth Certified
Supplier to place the Direct Connect, which shall be provisioned using facilities owned
by TC SYSTEMS. TC SYSTEMS-provisioned DC’s shall utilize BellSouth common
cable support structure. There will be a recurring charge per linear foot, per cable of
the actual common cable support structure used by TC SYSTEMS to provision the
Direct Connects between its virtual/physical Collocation Spaces. In those instances
where TC SYSTEMS’s virtual/physical Collocation Space is contiguous in the central
office, TC SYSTEMS will have the option of using TC SYSTEMS’s own technicians
to deploy the Direct Connects using either electrical or optical facilities between its
Collocation Spaces by constructing its own dedicated cable support structure. TC
SYSTEMS will deploy such electrical or optical connections directly between its own
facilities without being routed through BellSouth’s equipment. TC SYSTEMS may
not self-provision Direct Connects on any BellSouth distribution frame, POT, DSX
(Digital System Cross-Connect) or LGX (Light Guide Cross-Connect). TC
SYSTEMS is responsible for ensuring the integrity of the signal.
To place an order for Direct Connects, TC SYSTEMS must submit an Initial
Application or Subsequent Application. Fees associated with Direct Connect
applications, if any, are addressed in Sections 6.2 and 6.3.1 of this Attachment.
