BellSouth is required to comply with these codes. TC SYSTEMS must submit an
application to BellSouth for the appropriate amount of Collocation Space that TC
SYSTEMS requires in order to install this type of power arrangement. BellSouth will
evaluate the request and determine if the appropriate amount of space is available
within the BellSouth Premises for the installation of TC SYSTEMS’s power
equipment and facilities. This type of power arrangement must be located in an
appropriate area in the BellSouth Premises that has been properly conditioned for the
installation of power equipment and conforms to the applicable national, regional, state
and local safety, electrical, fire and building codes. BellSouth shall waive the
application fee or any other nonrecurring charge that would otherwise be due from a
CLEC that decides to reconfigure an existing collocation power arrangement so as to
purchase power directly from an electric utility company as provided herein. TC
SYSTEMS shall be responsible for the recurring charges associated with the additional
space needed in the BellSouth Premises for this type of power arrangement, including
space required to place associated power-related equipment and facilities (i.e.,
batteries, generator, fuse panel, power meter, etc.). If there is no space available for
this type of power arrangement in the requested BellSouth Premises, BellSouth may
seek a waiver of these requirements from the Commission for the BellSouth Premises
requested. TC SYSTEMS would have the option to order its power needs directly
from BellSouth.
8.7 Security Escort. A security escort will be required whenever TC SYSTEMS or its
approved agent desires access to the entrance manhole or must have access to a
BellSouth Premises after the one (1) accompanied site visit allowed pursuant to
Section 5.9 prior to completing BellSouth’s Security Training requirements. The rates
for security escort service are assessed, beginning with the scheduled escort time,
pursuant to the fee schedule in Exhibit B. BellSouth will wait for one-half (1/2) hour
after the scheduled time for such an escort and TC SYSTEMS shall pay for such halfhour
charges in the event TC SYSTEMS fails to show up.
8.8 Cable Record charges. These charges apply for work required to add or change
existing cable records assigned to TC SYSTEMS in BellSouth’s database systems.
The VG/DS0 per cable record charge is for a maximum of 3600 records. The Fiber
cable record charge is for a maximum of 99 records. The Cable Record charges are
assessed as nonrecurring fees in all BellSouth states, other than Louisiana, and will be
billed upon receipt of TC SYSTEMS’s BFFO.
8.9 Other. If no rate is identified in the contract, the rate for the specific service
or function will be negotiated by the Parties upon request by either Party.
9. Mechanics Liens
9.1 If any mechanics lien or other liens shall be filed against property of either Party
(BellSouth or TC SYSTEMS), or any improvement thereon by reason of or arising
out of any labor or materials furnished or alleged to have been furnished or to be
furnished to or for the other Party or by reason of any changes, or additions to said
