and/or safety considerations to the Collocation Space or the Bell<strong>South</strong> Premises,<br />

without the express written consent of Bell<strong>South</strong>, which shall not be unreasonably<br />

withheld. The cost of any such rearrangement, modification, augment, improvement,<br />

addition, and/or other alteration shall be paid by <strong>TC</strong> SYSTEMS, and shall require a<br />

Subsequent Application and will result in the assessment of the applicable application<br />

fee as set forth in Section 6.3.1, which will be billed by Bell<strong>South</strong> on the date that<br />

Bell<strong>South</strong> provides <strong>TC</strong> SYSTEMS with an Application Response.<br />

5.22 Janitorial Service. <strong>TC</strong> SYSTEMS shall be responsible for the general upkeep of its<br />

Collocation Space. <strong>TC</strong> SYSTEMS shall arrange directly with a Bell<strong>South</strong> Certified<br />

Supplier for janitorial services applicable to Caged Collocation Space. Bell<strong>South</strong> shall<br />

provide a list of such suppliers on a Bell<strong>South</strong> Premises-specific basis, upon request.<br />

6. Ordering and Preparation of Collocation Space<br />

6.1 If any state or federal regulatory agency imposes procedures or intervals applicable to<br />

<strong>TC</strong> SYSTEMS and Bell<strong>South</strong> that are different from the procedures or intervals set<br />

forth in this Section, whether now in effect or that become effective after execution of<br />

this Agreement, those procedures or intervals shall supersede the requirements set<br />

forth herein for that jurisdiction for all applications that are submitted for the first time<br />

after the effective date thereof.<br />

6.2 Initial Application. For <strong>TC</strong> SYSTEMS’s initial equipment placement, <strong>TC</strong> SYSTEMS<br />

shall input a Physical Expanded Interconnection Application Document (Initial<br />

Application) directly into Bell<strong>South</strong>’s electronic application (e.Application) system for<br />

processing. The Initial Application is considered Bona Fide when it is complete and<br />

accurate, meaning that all of the required fields on the application are completed with<br />

the appropriate type of information. An application fee will apply to each application<br />

submitted by <strong>TC</strong> SYSTEMS and will be billed by Bell<strong>South</strong> on the date Bell<strong>South</strong><br />

provides <strong>TC</strong> SYSTEMS with an Application Response.<br />

6.3 Subsequent Application. In the event <strong>TC</strong> SYSTEMS or <strong>TC</strong> SYSTEMS’s Guest(s)<br />

desires to modify its use of the Collocation Space after a BFFO, <strong>TC</strong> SYSTEMS shall<br />

complete an application (Subsequent Application) that contains all of the detailed<br />

information associated with the alteration related to the Collocation Space, as defined<br />

in Section 5.13 of this Attachment. The Subsequent Application will be considered<br />

Bona Fide when it is complete and accurate, meaning that all of the required fields on<br />

the Subsequent Application are completed with the appropriate type of information<br />

associated with the alteration. Bell<strong>South</strong> shall determine what modifications, if any, to<br />

the Bell<strong>South</strong> Premises are required to accommodate the change requested by <strong>TC</strong><br />

SYSTEMS in the application. Such modifications to the Bell<strong>South</strong> Premises may<br />

include, but are not limited to, floor loading changes, changes necessary to meet<br />

HVAC requirements, changes to power plant requirements, equipment additions, etc.<br />
