and/or safety considerations to the Collocation Space or the BellSouth Premises,
without the express written consent of BellSouth, which shall not be unreasonably
withheld. The cost of any such rearrangement, modification, augment, improvement,
addition, and/or other alteration shall be paid by TC SYSTEMS, and shall require a
Subsequent Application and will result in the assessment of the applicable application
fee as set forth in Section 6.3.1, which will be billed by BellSouth on the date that
BellSouth provides TC SYSTEMS with an Application Response.
5.22 Janitorial Service. TC SYSTEMS shall be responsible for the general upkeep of its
Collocation Space. TC SYSTEMS shall arrange directly with a BellSouth Certified
Supplier for janitorial services applicable to Caged Collocation Space. BellSouth shall
provide a list of such suppliers on a BellSouth Premises-specific basis, upon request.
6. Ordering and Preparation of Collocation Space
6.1 If any state or federal regulatory agency imposes procedures or intervals applicable to
TC SYSTEMS and BellSouth that are different from the procedures or intervals set
forth in this Section, whether now in effect or that become effective after execution of
this Agreement, those procedures or intervals shall supersede the requirements set
forth herein for that jurisdiction for all applications that are submitted for the first time
after the effective date thereof.
6.2 Initial Application. For TC SYSTEMS’s initial equipment placement, TC SYSTEMS
shall input a Physical Expanded Interconnection Application Document (Initial
Application) directly into BellSouth’s electronic application (e.Application) system for
processing. The Initial Application is considered Bona Fide when it is complete and
accurate, meaning that all of the required fields on the application are completed with
the appropriate type of information. An application fee will apply to each application
submitted by TC SYSTEMS and will be billed by BellSouth on the date BellSouth
provides TC SYSTEMS with an Application Response.
6.3 Subsequent Application. In the event TC SYSTEMS or TC SYSTEMS’s Guest(s)
desires to modify its use of the Collocation Space after a BFFO, TC SYSTEMS shall
complete an application (Subsequent Application) that contains all of the detailed
information associated with the alteration related to the Collocation Space, as defined
in Section 5.13 of this Attachment. The Subsequent Application will be considered
Bona Fide when it is complete and accurate, meaning that all of the required fields on
the Subsequent Application are completed with the appropriate type of information
associated with the alteration. BellSouth shall determine what modifications, if any, to
the BellSouth Premises are required to accommodate the change requested by TC
SYSTEMS in the application. Such modifications to the BellSouth Premises may
include, but are not limited to, floor loading changes, changes necessary to meet
HVAC requirements, changes to power plant requirements, equipment additions, etc.
