such information, in lieu of the PLU factor, shall at the company’s option be utilized<br />

to determine the appropriate reciprocal compensation to be paid.<br />

14.19 Audits. On thirty (30) days’ written notice, each Party must provide the other the<br />

ability and opportunity to conduct an annual audit of the traffic reported. Bell<strong>South</strong><br />

and <strong>TC</strong> SYTEMS shall retain records of call detail for a minimum of nine months<br />

from which a PLU, PLF and/or PIU can be ascertained. The audit shall be<br />

accomplished during normal business hours at an office designated by the Party<br />

being audited. Audit requests shall not be submitted more frequently than one (1)<br />

time per calendar year. Audits shall be performed by a mutually acceptable<br />

independent auditor paid for by the Party requesting the audit. The PLU, PLF,<br />

and/or PIU shall be adjusted based upon the audit results and shall apply to the usage<br />

for the quarter the audit was completed, to the usage for the quarter prior to the<br />

completion of the audit, and to the usage for the two quarters following the<br />

completion of the audit. If, as a result of an audit, either Party is found to have<br />

overstated the PLU, PLF and/or PIU by twenty percentage points (20%) or more,<br />

that Party shall reimburse the auditing Party for the cost of the audit.<br />

15 Toll Free Traffic<br />

15.1 If <strong>TC</strong> SYTEMS chooses Bell<strong>South</strong> to perform the Service Switching Point (SSP)<br />

Function (i.e., handle Toll Free database queries) from Bell<strong>South</strong>’s switches, all <strong>TC</strong><br />

SYTEMS originating Toll Free traffic shall be delivered using either GR-394 format<br />

with Carrier Code “0110” and a mutually agreed upon Circuit Code or GR-317-<br />

CORE format as appropriate.<br />

15.2 All post-query Toll Free calls for which <strong>TC</strong> SYTEMS performs the SSP function, if<br />

delivered to Bell<strong>South</strong>, shall be delivered using GR-394 format for calls destined to<br />

IXCs, and GR-317 format for calls destined to end offices that directly subtend a<br />

Bell<strong>South</strong> access tandem within the LATA.<br />

16 INTRALATA 8YY TRAFFIC COMPENSATION<br />

16.1 Where an intraLATA 8YY call originates on the physical network of one of the<br />

Parties within one exchange and terminates on the network of the other Party, (as<br />

the 8YY service provider) in either the same exchange or other local calling area<br />

associated with the originating exchange as defined and specified in the originating<br />

Party’s tariff the Parties agree that the call will be identified as subject to reciprocal<br />

compensation in the same manner as provided for in Section 14 above.<br />

16.2 The Parties will meet within 60 days of the Effective Date of this Agreement to<br />

develop a mutually acceptable process for implementing this provision.<br />

16.3 Traffic exchanged between the Parties pursuant to Section 16.1 are billed to and<br />

paid for by the terminating 800/8YY Service Provider, regardless of which Party<br />

performs the 800 query.<br />
