Bell<strong>South</strong> denies collocation of <strong>TC</strong> SYSTEMS’s equipment, citing safety standards,<br />

Bell<strong>South</strong> must provide to <strong>TC</strong> SYSTEMS within five (5) business days of the denial a<br />

list of all equipment that Bell<strong>South</strong> locates at the premises in question, together with<br />

an affidavit attesting that all of that equipment meets or exceeds the safety standard<br />

that Bellsouth contends <strong>TC</strong> SYSTEMS’s equipment fails to meet. This affidavit must<br />

set forth in detail: the exact safety requirement that <strong>TC</strong> SYSTEMS’s equipment does<br />

not satisfy; Bell<strong>South</strong>’s basis for concluding that <strong>TC</strong> SYSTEMS’s equipment does not<br />

meet this safety requirement; and Bell<strong>South</strong>’s basis for concluding why collocation of<br />

equipment not meeting this safety requirement would compromise network safety.<br />

5.5 <strong>TC</strong> SYSTEMS shall not request more DS0, DS1, DS3 and optical terminations for a<br />

collocation arrangement than the total port or termination capacity of the equipment<br />

physically installed in the arrangement. The total capacity of the equipment collocated<br />

in the arrangement will include equipment contained in an application, as well as<br />

equipment already placed in the collocation arrangement. If full network termination<br />

capacity of the equipment being installed is not requested in the application, additional<br />

network terminations for the installed equipment will require the submission of another<br />

application. In the event <strong>TC</strong> SYSTEMS submits an application for terminations that<br />

will exceed the total capacity of the collocated equipment, <strong>TC</strong> SYSTEMS will be<br />

informed of the discrepancy by Bell<strong>South</strong> and required to submit a revision to the<br />

application.<br />

5.6 Commencing with the most current calendar quarter after the effective date of this<br />

Attachment, and thereafter with respect to each subsequent calendar quarter during<br />

the term of this Attachment, <strong>TC</strong> SYSTEMS will, no later than thirty (30) days after<br />

the close of such calendar quarter, provide a report to ICS Collocation Product<br />

Management, Room 34A55, 675 W. Peachtree Street, Atlanta, Georgia 30375 listing<br />

any equipment in the Collocation Space that was added during the calendar quarter for<br />

which there is a UCC-1 lien holder or another entity that has a secured financial<br />

interest in such equipment. This shall be defined as “Secured Equipment”. If no<br />

Secured Equipment has been installed within a given calendar quarter, no report shall<br />

be due hereunder in connection with such calendar quarter.<br />

5.7 <strong>TC</strong> SYSTEMS shall not use the Collocation Space for marketing purposes, nor shall it<br />

place any identifying signs or markings outside the Collocation Space or on the<br />

grounds of the Bell<strong>South</strong> Premises.<br />

5.8 <strong>TC</strong> SYSTEMS shall place a plaque or affix other identification (e.g., stenciling) to <strong>TC</strong><br />

SYSTEMS’s equipment, including the appropriate emergency contacts with their<br />

corresponding telephone numbers, in order for Bell<strong>South</strong> to properly identify <strong>TC</strong><br />

SYSTEMS’s equipment in the case of an emergency.<br />

5.9 Entrance Facilities. <strong>TC</strong> SYSTEMS may elect to place <strong>TC</strong> SYSTEMS-owned or <strong>TC</strong><br />

SYSTEMS-leased fiber entrance facilities into its Collocation Space. Bell<strong>South</strong> will<br />

designate the point of interconnection in close proximity to the Bell<strong>South</strong> Premises<br />

building housing the Collocation Space, such as at an entrance manhole or a cable<br />

CCCS 241 of 433
