SYSTEMS not possessing identification issued by <strong>TC</strong> SYSTEMS or who has violated<br />

any of Bell<strong>South</strong>’s policies as outlined in the CLEC Security Training documents. <strong>TC</strong><br />

SYSTEMS shall hold Bell<strong>South</strong> harmless for any damages resulting from such<br />

removal of its personnel from a Bell<strong>South</strong> Premises. <strong>TC</strong> SYSTEMS shall be solely<br />

responsible for ensuring that any Guest(s) of <strong>TC</strong> SYSTEMS is in compliance with all<br />

subsections of this Section.<br />

11.4 <strong>TC</strong> SYSTEMS shall not assign to the Bell<strong>South</strong> Premises any personnel with records<br />

of felony criminal convictions. <strong>TC</strong> SYSTEMS shall not assign to the Bell<strong>South</strong><br />

Premises any personnel with records of misdemeanor convictions, except for<br />

misdemeanor traffic violations, without advising Bell<strong>South</strong> of the nature and gravity of<br />

the offense(s). Bell<strong>South</strong> reserves the right to refuse building access to any <strong>TC</strong><br />

SYSTEMS personnel who have been identified to have misdemeanor criminal<br />

convictions. Notwithstanding the foregoing, in the event that <strong>TC</strong> SYSTEMS chooses<br />

not to advise Bell<strong>South</strong> of the nature and gravity of any misdemeanor conviction, <strong>TC</strong><br />

SYSTEMS may, in the alternative, certify to Bell<strong>South</strong> that it shall not assign to the<br />

Bell<strong>South</strong> Premises any personnel with records of misdemeanor convictions (other<br />

than misdemeanor traffic violations).<br />

11.4.1 <strong>TC</strong> SYSTEMS shall not knowingly assign to the Bell<strong>South</strong> Premises any individual<br />

who was a former employee of Bell<strong>South</strong> and whose employment with Bell<strong>South</strong> was<br />

terminated for a criminal offense whether or not Bell<strong>South</strong> sought prosecution of the<br />

individual for the criminal offense.<br />

11.4.2 <strong>TC</strong> SYSTEMS shall not knowingly assign to the Bell<strong>South</strong> Premises any individual<br />

who was a former supplier of Bell<strong>South</strong> and whose access to a Bell<strong>South</strong> Premises<br />

was revoked due to commission of a criminal offense whether or not Bell<strong>South</strong> sought<br />

prosecution of the individual for the criminal offense.<br />

11.5 For each <strong>TC</strong> SYSTEMS employee or agent hired by <strong>TC</strong> SYSTEMS within five years<br />

of being considered for work on the Bell<strong>South</strong> Premises, who requires access to a<br />

Bell<strong>South</strong> Premises pursuant to this Attachment, <strong>TC</strong> SYSTEMS shall furnish<br />

Bell<strong>South</strong>, prior to an employee or agent gaining such access, a certification that the<br />

aforementioned background check and security training were completed. The<br />

certification will contain a statement that no felony convictions were found and certify<br />

that the employee completed the security training. If the employee’s criminal history<br />

includes misdemeanor convictions, <strong>TC</strong> SYSTEMS will disclose the nature of the<br />

convictions to Bell<strong>South</strong> at that time. In the alternative, <strong>TC</strong> SYSTEMS may certify to<br />

Bell<strong>South</strong> that it shall not assign to the Bell<strong>South</strong> Premises any personnel with records<br />

of misdemeanor convictions other than misdemeanor traffic violations.<br />

11.5.1 For all other <strong>TC</strong> SYSTEMS employees requiring access to a Bell<strong>South</strong> Premises<br />

pursuant to this Attachment, <strong>TC</strong> SYSTEMS shall furnish Bell<strong>South</strong>, prior to an<br />

employee gaining such access, a certification that the employee is not subject to the<br />

requirements of Section 11.5 above and that security training was completed by the<br />

employee.<br />
