request for a tour of the Remote Site Location within five (5) calendar days of the<br />

Denial of the Application. Notwithstanding the foregoing, the Parties may agree to<br />

conduct a tour within thirty (30) calendar days of the Denial of Application.<br />

6.6 Filing of Petition for Waiver. Upon Denial of Application Bell<strong>South</strong> will timely file a<br />

petition with the Commission pursuant to 47 U.S.C. § 251(c)(6). Bell<strong>South</strong> shall<br />

provide to the Commission any information requested by that Commission. Such<br />

information shall include which space, if any, Bell<strong>South</strong> or any of Bell<strong>South</strong>’s affiliates<br />

have reserved for future use and a detailed description of the specific future uses for<br />

which the space has been reserved. Subject to an appropriate nondisclosure agreement<br />

or provision, Bell<strong>South</strong> shall permit <strong>TC</strong> SYSTEMS to inspect any plans or diagrams<br />

that Bell<strong>South</strong> provides to the Commission.<br />

6.7 Waiting List. On a first-come, first-served basis governed by the date of receipt of an<br />

application or Letter of Intent, Bell<strong>South</strong> will maintain a waiting list of requesting<br />

carriers who have either received a Denial of Application or, where it is publicly<br />

known that the Remote Site Location is out of space, have submitted a Letter of Intent<br />

to collocate. Bell<strong>South</strong> will notify the telecommunications carriers on the waiting list<br />

that can be accommodated by the amount of space that becomes available according to<br />

the position of the telecommunications carriers on said waiting list.<br />

6.7.1 When space becomes available, <strong>TC</strong> SYSTEMS must submit an updated, complete,<br />

and correct application to Bell<strong>South</strong> within thirty (30) calendar days of such<br />

notification. If <strong>TC</strong> SYSTEMS has originally requested caged Remote Collocation<br />

Space and cageless Remote Collocation Space becomes available, <strong>TC</strong> SYSTEMS may<br />

refuse such space and notify Bell<strong>South</strong> in writing within that time that <strong>TC</strong> SYSTEMS<br />

wants to maintain its place on the waiting list without accepting such space. <strong>TC</strong><br />

SYSTEMS may accept an amount of space less than its original request by submitting<br />

an application as set forth above, and upon request, may maintain its position on the<br />

waiting list for the remaining space that was initially requested. If <strong>TC</strong> SYSTEMS<br />

does not submit such an application or notify Bell<strong>South</strong> in writing as described above,<br />

Bell<strong>South</strong> will offer such space to the next telecommunications carrier on the waiting<br />

list and remove <strong>TC</strong> SYSTEMS from the waiting list. Upon request, Bell<strong>South</strong> will<br />

advise <strong>TC</strong> SYSTEMS as to its position on the list.<br />

6.8 Application Response.<br />

6.8.1 When space has been determined to be available, Bell<strong>South</strong> will provide an<br />

Application Response within twenty (20) calendar days of receipt of a Bona Fide<br />

application. The Application Response will include, at a minimum, the configuration<br />

of the space, the Cable Installation Fee, Cable Records Fee, and the space preparation<br />

fees, as described in Section 8.<br />

6.9 Application Modifications.<br />
