11.1 The Parties will work cooperatively to install and maintain a reliable network. <strong>TC</strong><br />

SYTEMS and Bell<strong>South</strong> will exchange appropriate information (e.g., maintenance<br />

contact numbers, escalation procedures, network information, information required<br />

to comply with law enforcement and other security agencies of the Government) to<br />

achieve this desired reliability. In addition, the Parties will work cooperatively to<br />

apply sound network management principles to alleviate or to prevent congestion.<br />

11.2 Each Party recognizes a responsibility to follow the standards that may be agreed to<br />

between the Parties and to employ characteristics and methods of operation that will<br />

not interfere with or impair the service or any facilities of the other or any third<br />

parties connected with or involved directly in the network of the other.<br />

12 Outage Notification and Repair Standard<br />

12.1 Planned Outages. Bell<strong>South</strong> will use best efforts to notify <strong>TC</strong> SYTEMS of any<br />

significant planned Bell<strong>South</strong> network outage in substantially the same time and<br />

manner as it provides notice to itself or to its End User Customers, its Affiliates, or<br />

any other party. Upon such notice, <strong>TC</strong> SYTEMS may submit a reasonable request<br />

for additional information relevant to the scheduled Bell<strong>South</strong> network outage and<br />

Bell<strong>South</strong> may provide such information to the extent the scheduled maintenance<br />

activity may impact <strong>TC</strong> SYTEMS and such information is reasonably necessary for<br />

<strong>TC</strong> SYTEMS to identify and analyze potential risks associated with such an outage.<br />

Bell<strong>South</strong> may expedite or delay scheduled Bell<strong>South</strong> network outages as a result of<br />

unscheduled maintenance or other unforeseen events. In those instances where<br />

Bell<strong>South</strong> will not perform a scheduled network outage at the announced times,<br />

Bell<strong>South</strong> will make best efforts to provide <strong>TC</strong> SYTEMS with as much notice as is<br />

reasonably possible concerning the changed schedule.<br />

12.2 Unplanned Outage. For purposes of this section, a significant unplanned Bell<strong>South</strong><br />

network outage is defined as set forth below, which is consistent with 47 CFR<br />

63.100, which includes but is not limited to:<br />

12.2.1.1 An outage which potentially affects a 911 special facility is defined as a significant<br />

service degradation, switch or transport, where rerouting to the same or an<br />

alternative answering location was not implemented, and involves one or more of the<br />

following situations:<br />

12.2.1.2 Isolation of one or more Public Service Answering Points (PSAPs) for 24 hours or<br />

more, if the isolated PSAPs collectively serve less than 30,000 or more access lines,<br />

based on the carrier's database of lines served by each PSAP; or<br />

12.2.1.3 Loss of call processing capabilities in the E911 tandem(s), for 30 minutes or more,<br />

regardless of the number of customers affected; or<br />
