requested equipment is necessary based on the criteria established by the FCC.<br />

Multifunctional equipment placed on the Bell<strong>South</strong> Premises must not place any<br />

greater relative burden on Bell<strong>South</strong>’s property than comparable single function<br />

equipment.<br />

5.4 Whenever Bell<strong>South</strong> objects to collocation of equipment by <strong>TC</strong> SYSTEMS for<br />

purposes within the scope of section 25 1 (c) (6) of the Act, Bell<strong>South</strong> shall prove to<br />

the state commission that the equipment is not necessary for interconnection or access<br />

to unbundled network elements under the standards set forth above in this Section.<br />

Bell<strong>South</strong> may not object to the collocation of equipment on the grounds that the<br />

equipment does not comply with safety or engineering standards that are more<br />

stringent than the safety or engineering standards that Bell<strong>South</strong> applies to its own<br />

equipment. Bell<strong>South</strong> may not object to the collocation of equipment on the ground<br />

that the equipment fails to comply with Network Equipment and Building<br />

Specifications performance standards or any other performance standards. If<br />

Bell<strong>South</strong> denies collocation of <strong>TC</strong> SYSTEMS’s equipment, citing safety standards,<br />

Bell<strong>South</strong> must provide to <strong>TC</strong> SYSTEMS within five (5) business days of the denial a<br />

list of all equipment that Bell<strong>South</strong> locates at the premises in question, together with<br />

an affidavit attesting that all of that equipment meets or exceeds the safety standard<br />

that Bellsouth contends <strong>TC</strong> SYSTEMS’s equipment fails to meet. This affidavit must<br />

set forth in detail: the exact safety requirement that <strong>TC</strong> SYSTEMS’s equipment does<br />

not satisfy; Bell<strong>South</strong>’s basis for concluding that <strong>TC</strong> SYSTEMS’s equipment does not<br />

meet this safety requirement; and Bell<strong>South</strong>’s basis for concluding why collocation of<br />

equipment not meeting this safety requirement would compromise network safety.<br />

5.5 All <strong>TC</strong> SYSTEMS equipment installation shall comply with Bell<strong>South</strong> TR 73503-11h,<br />

“Grounding - Engineering Procedures”. Metallic cable sheaths and metallic strength<br />

members of optical fiber cables as well as the metallic cable sheaths of all copper<br />

conductor cables shall be bonded to the designated grounding bus for the Remote Site<br />

Location. All copper conductor pairs, working and non-working, shall be equipped<br />

with a solid-state protector unit (over-voltage protection only), which has been listed<br />

by a nationally recognized testing laboratory.<br />

5.6 Commencing with the most current calendar quarter after the effective date of this<br />

Attachment, and thereafter with respect to each subsequent calendar quarter during<br />

the term of this Attachment, <strong>TC</strong> SYSTEMS will, no later than thirty (30) days after<br />

the close of such calendar quarter, provide a report to ICS Collocation Product<br />

Management, Room 34A55, 675 W. Peachtree Street, Atlanta, Georgia 30375 listing<br />

any equipment in the Remote Collocation Space that was added during the calendar<br />

quarter for which there is a UCC-1 lien holder or another entity that has a secured<br />

financial interest in such equipment. This shall be defined as “Secured Equipment”. If<br />

no Secured Equipment has been installed within a given calendar quarter, no report<br />

shall be due hereunder in connection with such calendar quarter.<br />
