8.1.1 The purpose of the prelicense survey is to determine whether Licensee's proposed<br />

attachments to Bell<strong>South</strong>'s poles or occupancy of Bell<strong>South</strong>'s conduit and ducts<br />

will substantially interfere with use of Bell<strong>South</strong>'s facilities by Bell<strong>South</strong> and others<br />

with facilities occupying, connected or attached to Bell<strong>South</strong>'s pole or conduit<br />

system; and to provide information to Licensee for its determination of whether the<br />

pole, anchor, anchor/guy strand, conduit, duct, or right-of-way is suitable for its<br />

use.<br />

8.1.2 Based on information provided by Bell<strong>South</strong> and the survey, Licensee shall<br />

determine whether Bell<strong>South</strong>'s pole, anchor, anchor/guy strand, conduit and duct<br />

facilities are suitable to meet Licensee's needs.<br />

8.1.3 Bell<strong>South</strong> may not unreasonably refuse to continue to process an application based<br />

on Bell<strong>South</strong>'s determination that Licensee's proposed use of Bell<strong>South</strong>'s facilities<br />

will not be in compliance with applicable requirements, specifications, rules,<br />

regulations, ordinances, and laws. Licensee shall be responsible for making its<br />

own, independent determination that its use of such facilities will be in compliance<br />

with such requirements, specifications, rules, regulations, ordinances and laws.<br />

Licensee acknowledges that Bell<strong>South</strong> is not explicitly or implicitly warranting to<br />

Licensee that Licensee's proposed use of Bell<strong>South</strong>'s facilities will be in compliance<br />

with applicable requirements, specifications, rules, regulations, ordinances, and<br />

laws.<br />

8.2 Administrative Processing. The administrative processing portion of the prelicense<br />

survey (which includes without limitation processing the application, preparing<br />

make-ready work orders, notifying joint users and other persons and entities of<br />

work requirements and schedules, coordinating the relocation/rearrangement of<br />

Bell<strong>South</strong> and/or other licensed facilities) will be performed by Bell<strong>South</strong> at<br />

Licensee’s expense. Anything to the contrary herein notwithstanding, Bell<strong>South</strong><br />

shall bear no responsibility for the relocation, rearrangement or removal of<br />

facilities used for the transmission or distribution of electric power.<br />

9. ISSUANCE OF LICENSES<br />

9.1 Obligation to Issue Licenses. Bell<strong>South</strong> shall issue a license to Licensee pursuant<br />

to this Section 9. Bell<strong>South</strong> and Licensee acknowledge that each application for a<br />

license shall be evaluated on an individual basis. Nothing contained in this section<br />

shall be construed as abridging any independent pole attachment rights or conduit<br />

or duct or rights-of-way access rights which Licensee may have under the<br />

provisions of any applicable federal or state laws or regulations governing access<br />

to Bell<strong>South</strong>'s poles, conduits and ducts and right-of-way to the extent the same<br />

are not inconsistent with the Telecommunications Act of 1996. Each license<br />

issued hereunder shall be for an indefinite term, subject to Licensee's compliance<br />

with the provisions applicable to such license and further subject to Licensee's right<br />

to terminate such license at any time for any reason upon at least thirty (30) days'<br />

prior written notice.<br />

9.2 Multiple Applications. Licensee acknowledges that multiple parties including<br />

Bell<strong>South</strong> may seek to place their facilities in Bell<strong>South</strong>'s conduit and ducts or on<br />
