SYSTEMS performs testing of its facilities and submits a trouble ticket to Bell<strong>South</strong><br />

indicating a trouble exists on Bell<strong>South</strong>’s side of the demarcation, then Bell<strong>South</strong> will<br />

perform the required testing on its side of the demarcation point to isolate the trouble<br />

reported by <strong>TC</strong> SYSTEMS. If Bell<strong>South</strong> does find that a trouble exists on its side of<br />

the demarcation point after it has performed the required testing of its facilities, then<br />

Bell<strong>South</strong> will take the necessary action to repair its facilities to eliminate the trouble<br />

and <strong>TC</strong> SYSTEMS will not be charged for submission of the trouble ticket. If<br />

Bell<strong>South</strong> cannot locate any trouble on its side of the demarcation point, then<br />

Bell<strong>South</strong> will assess <strong>TC</strong> SYSTEMS the applicable Maintenance of Services charge as<br />

set forth in Section 13.3.1 of Bell<strong>South</strong>’s FCC Tariff No. 1, based on the amount of<br />

time, in half-hour increments, it takes a Bell<strong>South</strong> technician to complete the<br />

appropriate testing. If, within thirty (30) calendar days of Bell<strong>South</strong>’s billing of the<br />

Maintenance of Services charge, <strong>TC</strong> SYSTEMS performs its testing of the same<br />

facilities and finds that the trouble has not been eliminated and does not reside on <strong>TC</strong><br />

SYSTEMS’s side of the demarcation point, then <strong>TC</strong> SYSTEMS shall submit a second<br />

trouble ticket to Bell<strong>South</strong>. If, after testing has been performed by Bell<strong>South</strong>, the<br />

trouble is actually determined to be on Bell<strong>South</strong>’s side of the demarcation point,<br />

Bell<strong>South</strong> will not charge <strong>TC</strong> SYSTEMS for the submission of the trouble ticket.<br />

Bell<strong>South</strong> shall also credit <strong>TC</strong> SYSTEMS’s account for the amount of the original<br />

Maintenance of Service charge on this same facility, within the next billing cycle.<br />

5.13 Process for Repair and Maintenance of Intra-Office Wiring<br />

5.13.1 As needed, Bell<strong>South</strong> will cooperate fully with <strong>TC</strong> SYSTEMS to test and troubleshoot<br />

all intra-office wiring that goes through an IID, so that service troubles can be<br />

isolated to a particular intra-office wiring component and resolved by the Party with<br />

responsibility for that component.<br />

5.13.2 In the event that an <strong>TC</strong> SYSTEMS customer reports a repair and/or maintenance<br />

problem that requires testing of intra-office wiring and a Bell<strong>South</strong> technician is<br />

needed to complete that test, the Bell<strong>South</strong> technician will respond as soon as<br />

possible, but in any event in a timeframe no longer than that which Bell<strong>South</strong> would<br />

apply when responding on a repair report from its own customer.<br />

5.13.3 No trouble ticket may specify that the suspected faulty component is under the<br />

ownership of both Parties.<br />

5.13.4 Bell<strong>South</strong> is responsible for fixing problems with its wiring and/or equipment with<br />

minimal disruption to <strong>TC</strong> SYSTEMS or <strong>TC</strong> SYSTEMS customers.<br />

5.14 <strong>TC</strong> SYSTEMS’s Equipment and Facilities. <strong>TC</strong> SYSTEMS, or if required by this<br />

Attachment, <strong>TC</strong> SYSTEMS‘s Bell<strong>South</strong> Certified Supplier, is solely responsible for<br />

the design, engineering, installation, testing, provisioning, performance, monitoring,<br />

maintenance and repair of the equipment and facilities used by <strong>TC</strong> SYSTEMS which<br />

must be performed in compliance with all applicable Bell<strong>South</strong> Specifications. Such<br />

equipment and facilities may include, but are not limited to, cable(s), equipment, and<br />
