2.1.1.8.12 Modifications and Updates to the Wire Center List and Subsequent Transition<br />

Periods<br />

2.1.1.8.12.1 In the event Bell<strong>South</strong> identifies additional wire centers that meet the criteria set<br />

forth in Section 2.1.1.8.5, but that were not included in the Initial Wire Center<br />

List, Bell<strong>South</strong> shall include such additional wire centers in a carrier notification<br />

letter (CNL). Each such list of additional wire centers shall be considered a<br />

“Subsequent Wire Center List”.<br />

2.1.1.8.12.2 Effective fourteen (14) days after the date of a Bell<strong>South</strong> CNL providing a<br />

Subsequent Wire Center List, Bell<strong>South</strong> shall not be required to unbundle DS1<br />

and/or DS3 Loops, as applicable, in such additional wire center(s), except pursuant<br />

to the self-certification process as set forth in Section 1.6 of this Attachment.<br />

2.1.1.8.12.3 For purposes of Section 2.1.1.8.12, Bell<strong>South</strong> shall make available DS1 and DS3<br />

Loops that were in service for <strong>TC</strong> SYSTEMS in a wire center on the Subsequent<br />

Wire Center List as of the fourteenth (14th) day after the date of Bell<strong>South</strong>’s CNL<br />

identifying the Subsequent Wire Center List (Subsequent Embedded Base) until<br />

one hundred and twenty (120) days after the fourteenth (14th) business day from<br />

the date of Bell<strong>South</strong>'s CNL identifying the Subsequent Wire Center List<br />

(Subsequent Transition Period).<br />

2.1.1.8.12.4 Subsequent disconnects or loss of end users shall be removed from the Subsequent<br />

Embedded Base.<br />

2.1.1.8.12.5 The rates set forth in Exhibit B shall apply to the Subsequent Embedded Base<br />

during the Subsequent Transition Period.<br />

2.1.1.8.12.6 No later than sixty (60) days from Bell<strong>South</strong>'s CNL identifying the Subsequent<br />

Wire Center List, <strong>TC</strong> SYSTEMS shall submit a spreadsheet(s) identifying the<br />

Subsequent Embedded Base of circuits to be disconnected or converted to other<br />

Bell<strong>South</strong> services. The Parties agree to work cooperatively to confirm that the<br />

facilities on the spreadsheet are the facilities to be included in <strong>TC</strong> SYSTEMS’s<br />

Subsequent Embedded Base. The Parties shall negotiate a project schedule for the<br />

Conversion of the Subsequent Embedded Base. Bell<strong>South</strong> shall charge the nonrecurring<br />

switch-as-is rate for these conversions.<br />

2.1.1.8.12.6.1 If <strong>TC</strong> SYSTEMS fails to submit the spreadsheet(s) specified in Section<br />

2.1.1.8.12.6 above for at least 95% of its Subsequent Embedded Base within sixty<br />

(60) days after the date of Bell<strong>South</strong>’s CNL identifying the Subsequent Wire<br />

Center List, Bell<strong>South</strong> will identify <strong>TC</strong> SYSTEMS's remaining Subsequent<br />

Embedded Base, if any, and will transition such circuits to the equivalent tariffed<br />

Bell<strong>South</strong> service(s). Those circuits identified and transitioned by Bell<strong>South</strong> shall<br />

be subject to the applicable disconnect charges as set forth in this Agreement and<br />
