1.1 The Parties shall provide interconnection with each other’s network for the<br />

transmission and routing of telephone exchange service and exchange access service.<br />

1.1.1 Bell<strong>South</strong> shall permit <strong>TC</strong> SYTEMS to interconnect at any technically feasible point<br />

on the Bell<strong>South</strong> network, including, without limitation, tandems, end offices,<br />

outside plant facilities, Commercial Intra-Building Interconnections and as described<br />

in 47 CFR §51.305.The point where the parties interconnect shall be called a Point<br />

of Interconnection (“POI”) . Such POIs shall be used to (1) deliver Reciprocal<br />

Compensation Traffic originating on <strong>TC</strong> SYTEMS’s network to Bell<strong>South</strong> and (2)<br />

to exchange Meet Point Billing Traffic 3) and Transit Traffic.<br />

1.1.2 At <strong>TC</strong> SYTEMS’s sole discretion, <strong>TC</strong> SYTEMS will establish at least one or more<br />

POIs on Bell<strong>South</strong>’s network within a LATA in which <strong>TC</strong> SYTEMS offers local<br />

exchange service.<br />

1.1.3 Bell<strong>South</strong> shall deliver Reciprocal Compensation Traffic originating on the<br />

Bell<strong>South</strong> network and at such points mutually agreed to between the Parties or,<br />

lacking mutual agreement, at the POI established by <strong>TC</strong> SYTEMS for the delivery to<br />

Bell<strong>South</strong> of its Reciprocal Compensation Traffic originating on <strong>TC</strong> SYTEMS’s<br />

network.<br />

1.1.4 The originating Party shall compensate the terminating Party under terms of this<br />

Attachment for any transport that is used to carry Reciprocal Compensation Traffic<br />

between the POI and a distant switch within the same LATA as the POI serving the<br />

terminating end user. Such transport shall be either Dedicated Transport or<br />

Common Transport pursuant to the interconnection method elected by the<br />

originating party, subject to the terms of this Attachment.<br />

1.1.5 In the event that <strong>TC</strong> SYTEMS elects to offer service within a LATA using a switch<br />

located in another LATA, <strong>TC</strong> SYTEMS agrees to provide the transport for both<br />

Parties’ traffic between the remote <strong>TC</strong> SYTEMS switch and a point designated by<br />

<strong>TC</strong> SYTEMS (e.g., <strong>TC</strong> SYTEMS’s Point of Presence) within the LATA in which<br />

<strong>TC</strong> SYTEMS offers service. Such facility point of presence shall be deemed to be<br />

an <strong>TC</strong> SYTEMS Switch Center for the purposes of this Attachment.<br />

1.1.6 Installation, Testing Maintenance and Repair. Interconnection shall be equal in<br />

quality to that provided by Bell<strong>South</strong> to itself or any subsidiary, affiliate, or third<br />

party. “Equal in Quality” shall have the meaning accorded in Section 51.305(a)(3)<br />

of the FCC’s Rules, 47 C.F.R. § 51.305(a)(3). If Bell<strong>South</strong> is at any time unable to<br />

fulfill its obligations under this Section, it shall notify <strong>TC</strong> SYTEMS of its inability to<br />

do so and will negotiate alternative intervals in good faith. Bell<strong>South</strong> shall provide<br />
