construed in accordance with the obligations contained within 47 C.F.R. §<br />

51.325, et seq.<br />

24.15 Court Ordered Requests for Call Detail Records and Other Subscriber<br />

Information<br />

24.15.1 To the extent technically feasible, Bell<strong>South</strong> maintains call detail records for<br />

<strong>TC</strong> SYSTEMS end users for limited time periods and can respond to<br />

subpoenas and court ordered requests for this information. Bell<strong>South</strong> shall<br />

maintain such information for <strong>TC</strong> SYSTEMS end users for the same length<br />

of time it maintains such information for its own end users.<br />

24.15.2 <strong>TC</strong> SYSTEMS agrees that Bell<strong>South</strong> will respond to subpoenas and court<br />

ordered requests delivered directly to Bell<strong>South</strong> for the purpose of providing<br />

call detail records when the targeted telephone numbers belong to <strong>TC</strong><br />

SYSTEMS end users. Billing for such requests will be generated by<br />

Bell<strong>South</strong> and directed to the law enforcement agency initiating the request.<br />

24.15.3 Where Bell<strong>South</strong> is providing to <strong>TC</strong> SYSTEMS telecommunications services<br />

for resale then <strong>TC</strong> SYSTEMS agrees that in those cases where <strong>TC</strong><br />

SYSTEMS receives subpoenas or court ordered requests regarding targeted<br />

telephone numbers belonging to <strong>TC</strong> SYSTEMS end users, if <strong>TC</strong> SYSTEMS<br />

does not have the requested information, <strong>TC</strong> SYSTEMS will advise the law<br />

enforcement agency initiating the request to redirect the subpoena or court<br />

ordered request to Bell<strong>South</strong>. Where the request has been forwarded to<br />

Bell<strong>South</strong>, billing for call detail information will be generated by Bell<strong>South</strong><br />

and directed to the law enforcement agency initiating the request.<br />

24.15.4 In all other instances, <strong>TC</strong> SYSTEMS will provide <strong>TC</strong> SYSTEMS end user<br />

and/or other customer information that is available to <strong>TC</strong> SYSTEMS in<br />

response to subpoenas and court orders for their own end user records.<br />

When Bell<strong>South</strong> receives subpoenas or court ordered requests regarding<br />

targeted telephone numbers belonging to <strong>TC</strong> SYSTEMS end users,<br />

Bell<strong>South</strong> will advise the law enforcement agency initiating the request to<br />

redirect the subpoena or court ordered request to <strong>TC</strong> SYSTEMS.<br />

24.16 Filing of Agreement<br />

24.16.1 Upon execution of this Agreement, it shall be filed with the appropriate state<br />

regulatory agency pursuant to the requirements of Section 252 of the Act. If<br />

the regulatory agency imposes any filing or public interest notice fees<br />

regarding the filing or approval of the Agreement, the Parties shall equally<br />

share the cost of such filing and/or public interest notice fee.<br />

24.17 Other Proceedings<br />
