to any <strong>TC</strong> SYSTEMS personnel who have been identified to have misdemeanor<br />

criminal convictions. Notwithstanding the foregoing, in the event that <strong>TC</strong> SYSTEMS<br />

chooses not to advise Bell<strong>South</strong> of the nature and gravity of any misdemeanor<br />

conviction, <strong>TC</strong> SYSTEMS may, in the alternative, certify to Bell<strong>South</strong> that it shall not<br />

assign to the Bell<strong>South</strong> Remote Site Location any personnel with records of<br />

misdemeanor convictions (other than misdemeanor traffic violations).<br />

11.4.1 <strong>TC</strong> SYSTEMS shall not knowingly assign to the Bell<strong>South</strong> Remote Site Location any<br />

individual who was a former employee of Bell<strong>South</strong> and whose employment with<br />

Bell<strong>South</strong> was terminated for a criminal offense whether or not Bell<strong>South</strong> sought<br />

prosecution of the individual for the criminal offense.<br />

11.4.2 <strong>TC</strong> SYSTEMS shall not knowingly assign to the Bell<strong>South</strong> Remote Site Location any<br />

individual who was a former supplier of Bell<strong>South</strong> and whose access to a Bell<strong>South</strong><br />

Remote Site Location was revoked due to commission of a criminal offense whether<br />

or not Bell<strong>South</strong> sought prosecution of the individual for the criminal offense.<br />

11.5 For each <strong>TC</strong> SYSTEMS employee or agent hired by <strong>TC</strong> SYSTEMS within five years<br />

of being considered for work on the Bell<strong>South</strong> Remote Site Location, who requires<br />

access to a Bell<strong>South</strong> Remote Site Location pursuant to this Attachment, <strong>TC</strong><br />

SYSTEMS shall furnish Bell<strong>South</strong>, prior to an employee gaining such access, a<br />

certification that the aforementioned background check and security training were<br />

completed. The certification will contain a statement that no felony convictions were<br />

found and certifying that the security training was completed by the employee. If the<br />

employee’s criminal history includes misdemeanor convictions, <strong>TC</strong> SYSTEMS will<br />

disclose the nature of the convictions to Bell<strong>South</strong> at that time. In the alternative, <strong>TC</strong><br />

SYSTEMS may certify to Bell<strong>South</strong> that it shall not assign to the Bell<strong>South</strong> Remote<br />

Site Location any personnel with records of misdemeanor convictions other than<br />

misdemeanor traffic violations.<br />

11.5.1 For all other <strong>TC</strong> SYSTEMS employees requiring access to a Bell<strong>South</strong> Remote Site<br />

Location pursuant to this Attachment, <strong>TC</strong> SYSTEMS shall furnish Bell<strong>South</strong>, prior to<br />

an employee gaining such access, a certification that the employee is not subject to the<br />

requirements of Section 11.5 above and that security training was completed by the<br />

employee.<br />

11.6 At Bell<strong>South</strong>’s request, <strong>TC</strong> SYSTEMS shall promptly remove from Bell<strong>South</strong>’s<br />

Remote Site Location any employee of <strong>TC</strong> SYSTEMS Bell<strong>South</strong> does not wish to<br />

grant access to its Remote Site Location 1) pursuant to any investigation conducted by<br />

Bell<strong>South</strong> or 2) prior to the initiation of an investigation if an employee of <strong>TC</strong><br />

SYSTEMS is found interfering with the property or personnel of Bell<strong>South</strong> or another<br />

collocated telecommunications carrier, provided that an investigation shall promptly be<br />

commenced by Bell<strong>South</strong>.<br />
