to any TC SYSTEMS personnel who have been identified to have misdemeanor
criminal convictions. Notwithstanding the foregoing, in the event that TC SYSTEMS
chooses not to advise BellSouth of the nature and gravity of any misdemeanor
conviction, TC SYSTEMS may, in the alternative, certify to BellSouth that it shall not
assign to the BellSouth Remote Site Location any personnel with records of
misdemeanor convictions (other than misdemeanor traffic violations).
11.4.1 TC SYSTEMS shall not knowingly assign to the BellSouth Remote Site Location any
individual who was a former employee of BellSouth and whose employment with
BellSouth was terminated for a criminal offense whether or not BellSouth sought
prosecution of the individual for the criminal offense.
11.4.2 TC SYSTEMS shall not knowingly assign to the BellSouth Remote Site Location any
individual who was a former supplier of BellSouth and whose access to a BellSouth
Remote Site Location was revoked due to commission of a criminal offense whether
or not BellSouth sought prosecution of the individual for the criminal offense.
11.5 For each TC SYSTEMS employee or agent hired by TC SYSTEMS within five years
of being considered for work on the BellSouth Remote Site Location, who requires
access to a BellSouth Remote Site Location pursuant to this Attachment, TC
SYSTEMS shall furnish BellSouth, prior to an employee gaining such access, a
certification that the aforementioned background check and security training were
completed. The certification will contain a statement that no felony convictions were
found and certifying that the security training was completed by the employee. If the
employee’s criminal history includes misdemeanor convictions, TC SYSTEMS will
disclose the nature of the convictions to BellSouth at that time. In the alternative, TC
SYSTEMS may certify to BellSouth that it shall not assign to the BellSouth Remote
Site Location any personnel with records of misdemeanor convictions other than
misdemeanor traffic violations.
11.5.1 For all other TC SYSTEMS employees requiring access to a BellSouth Remote Site
Location pursuant to this Attachment, TC SYSTEMS shall furnish BellSouth, prior to
an employee gaining such access, a certification that the employee is not subject to the
requirements of Section 11.5 above and that security training was completed by the
employee.
11.6 At BellSouth’s request, TC SYSTEMS shall promptly remove from BellSouth’s
Remote Site Location any employee of TC SYSTEMS BellSouth does not wish to
grant access to its Remote Site Location 1) pursuant to any investigation conducted by
BellSouth or 2) prior to the initiation of an investigation if an employee of TC
SYSTEMS is found interfering with the property or personnel of BellSouth or another
collocated telecommunications carrier, provided that an investigation shall promptly be
commenced by BellSouth.
