1.7 Bell<strong>South</strong> shall relinquish any space held for future use before denying a request for<br />

virtual collocation on the grounds of space limitations, unless Bell<strong>South</strong> proves to the<br />

Commission that virtual collocation at that point is not technically feasible.<br />

1.8 Rates and Charges. <strong>TC</strong> SYSTEMS agrees to pay the rates and charges identified in<br />

Exhibit B attached hereto.<br />

1.9 Collocation Billing. Upon <strong>TC</strong> SYSTEMS’s request, Bell<strong>South</strong> will separate <strong>TC</strong><br />

SYSTEMS’s collocation charges between the Monthly Recurring Charges (MRCs)<br />

and the nonrecurring charges (NRCs) by establishing two unique Billing Account<br />

Numbers (BANs) for each collocation arrangement in a Bell<strong>South</strong> Central Office. One<br />

BAN will be used to capture all of <strong>TC</strong> SYSTEMS’s MRCs and the other BAN will be<br />

used to capture all of <strong>TC</strong> SYSTEMS’s NRCs for the collocation arrangement.<br />

Separate bills will be sent to the location specified by <strong>TC</strong> SYSTEMS for each type of<br />

charge.<br />

The billing label for the bills containing the MRCs for <strong>TC</strong> SYSTEMS’s collocation<br />

arrangements will be “Expanded Interconnection Services”. The billing label for the<br />

bills that reflect the NRCs for <strong>TC</strong> SYSTEMS’s collocation arrangements will be<br />

“Collocation”.<br />

Bell<strong>South</strong> will provide “split billing” for no more than two (2) BANs per collocation<br />

arrangement. When <strong>TC</strong> SYSTEMS submits an Initial Application then the initial rate<br />

for split billing, as set forth in Exhibit B, will be applied in addition to the Initial<br />

Application Fee. When <strong>TC</strong> SYSTEMS submits a Subsequent Application that<br />

contains new recurring or nonrecurring charges, the subsequent split billing rate, as set<br />

forth in Exhibit B, in addition to the appropriate Subsequent Application Fee will<br />

apply. Only when an Initial or Subsequent Application contains new recurring or<br />

nonrecurring charges will the appropriate initial or subsequent split bill rate apply.<br />

1.10 If any due date contained in this Attachment falls on a weekend or a National holiday,<br />

the due date will be the next business day thereafter. For intervals of ten (10) calendar<br />

days or less, National holidays will be excluded.<br />

1.11 The Parties agree to comply with all applicable federal, state, county, local and<br />

administrative laws, rules, ordinances, regulations and codes in the performance of<br />

their obligations hereunder.<br />

2. Space Availability Report<br />

2.1 Space Availability Report. Upon request from <strong>TC</strong> SYSTEMS, Bell<strong>South</strong> will provide<br />

a written report (Space Availability Report) describing in detail the space that is<br />

currently available for collocation at a particular Bell<strong>South</strong> Premises. This report will<br />

include the amount of Collocation Space available at the Bell<strong>South</strong> Premises<br />

requested, the number of collocators present at the Bell<strong>South</strong> Premises, any<br />

modifications in the use of the space since the last report on the Bell<strong>South</strong> Premises<br />
