processes and policies applicable to existing end user services not being purchased<br />

by <strong>TC</strong> SYSTEMS for resale, notices of new service offerings, and any changes to<br />

existing service offerings not being purchased by <strong>TC</strong> SYSTEMS for resale, or<br />

otherwise not requiring an amendment to this Agreement.<br />

3.23 Where Bell<strong>South</strong> discontinues a Resale Telecommunications Service, <strong>TC</strong><br />

SYSTEMS shall enjoy the same rights (e.g. transition or grandfather period) that<br />

Bell<strong>South</strong>’s own retail End Users may be subject to with respect to the service.<br />

3.24 Bell<strong>South</strong> and <strong>TC</strong> SYSTEMS shall provide local and toll dialing parity to each<br />

other with no unreasonable dialing delays. The post-dial delay (time elapsed<br />

between the last digit dialed and the first network response), call completion rate<br />

and transmission quality experienced by an <strong>TC</strong> SYSTEMS End User is at last<br />

equal in quality to that experienced by a similarly situated Bell<strong>South</strong> End User.<br />

Except for the loss of features that may be occasioned by the use of remote call<br />

forwarding or other number portability technologies, the <strong>TC</strong> SYSTEMS End User<br />

may retain its local telephone number with no loss of features or functionality<br />

according to the provisions in Attachment 5. Dialing parity shall be provided for<br />

all originating telecommunications services that require dialing to route a call.<br />

Bell<strong>South</strong> and <strong>TC</strong> SYSTEMS shall permit similarly situated telephone exchange<br />

service end users to dial the same number of digits to make a local telephone call<br />

notwithstanding the identity of the end user’s or the called party’s<br />

telecommunication service provider.<br />

4. Bell<strong>South</strong>’s Provision of Services to <strong>TC</strong> SYSTEMS<br />

4.1 Resale of Bell<strong>South</strong> services shall be as follows:<br />

4.1.1 The resale of telecommunications services shall be limited to users and uses<br />

conforming to the class of service restrictions.<br />

4.1.2 Hotel and Hospital PBX services are the only telecommunications services<br />

available for resale to Hotel/Motel and Hospital End Users, respectively.<br />

Similarly, Access Line Service for Customer Provided Coin Telephones is the only<br />

local service available for resale to Payphone Service Provider (PSP) customers.<br />

Shared Tenant Service customers can only be sold those local exchange access<br />

services available in Bell<strong>South</strong>’s A23 Shared Tenant Service Tariff in the states of<br />

Florida, Georgia, North <strong>Carolina</strong> and <strong>South</strong> <strong>Carolina</strong>, and in A27 in the states of<br />

Alabama, Kentucky, Louisiana, Mississippi and Tennessee.<br />

4.1.3 Bell<strong>South</strong> reserves the right to periodically audit services purchased by <strong>TC</strong><br />

SYSTEMS to establish compliance with the terms and conditions set forth above.<br />

Such audit shall not occur more than once in a calendar year. <strong>TC</strong> SYSTEMS shall<br />

make any and all records and data available to Bell<strong>South</strong> or Bell<strong>South</strong>’s auditors<br />

on a reasonable basis. Bell<strong>South</strong> shall bear the cost of said audit. Any information<br />
