transportation costs, and delay GHG emissions reductions in BC. These delays could<br />

potentially derail NGV initiatives (and its associated benefits) completely if fleet operators<br />

adopt conventional or viable alternative technologies.<br />

4. The Companies’ position for why we believe we have approvals to use <strong>EEC</strong> funds for NGVs<br />

is contained below and this makes for an efficient and less costly process to resolve this<br />

issue for all parties involved.<br />

The Companies have support from key stakeholders for the quick resolution of this uncertainty<br />

resulting from the Commission’s interim order on Waste Management, and the re-initiation of<br />

NGV incentive programs. As a result of a recent <strong>EEC</strong> Stakeholder Group held <strong>March</strong> 15, <strong>2011</strong>,<br />

<strong>FEI</strong> has received letters from multiple members of the Stakeholders Group supporting <strong>FEI</strong> has<br />

followed the established process in the use of <strong>EEC</strong> funding (Please see Appendix F for copies<br />

of these letters). The Companies thus submit that the necessary information is now available to<br />

address this issue in a meaningful way.<br />

10.2.3 RELEVANT COMMISSION APPROVALS<br />

There have been a number of regulatory events that led up to the Companies providing NGV<br />

funding. In this section the Companies outline the key aspects of past Commission orders that<br />

support NGV funding. As explained in detail below, <strong>FEI</strong> believes that the use of Innovative<br />

Technologies Program Area <strong>EEC</strong> funding for NGV initiatives is consistent with previous<br />

Commission decisions (Orders G-36-09, G-141-09, and G-140-09), and that <strong>FEI</strong> has been open<br />

and transparent with stakeholders about <strong>EEC</strong> activities and expenditures, including the use of<br />

<strong>EEC</strong> incentives for NGV.<br />

The following diagram summarizes the sequence of regulatory proceedings and events that<br />

touch on <strong>EEC</strong> funding.<br />
