IN THE MATTER OF<br />

the Utilities Commission Act, R.S.B.C. 1996, Chapter 473<br />

and<br />

An Application by Terasen Gas Inc.<br />

for Approval of <strong>2010</strong> and <strong>2011</strong> Revenue Requirements and Delivery Rates<br />

Negotiated Settlement Process<br />

A. On June 15, 2009, Terasen Gas Inc. (“TGI”) <strong>filed</strong> its <strong>2010</strong> and <strong>2011</strong> Revenue Requirements<br />

Application, which was supplemented by a filing on July 9, 2009 and amended by filings on<br />

August 14 and September 18, 2009 (the “Application”); and<br />

B. Amongst other things, the Application sought:<br />

1. An order pursuant to sections 59 to 61 of the Utilities Commission Act (the “Act”),<br />

approving delivery rates for all non-bypass customers effective January 1, <strong>2010</strong> and<br />

January 1, <strong>2011</strong>, representing an increase of 5.3 percent for <strong>2010</strong> and an additional<br />

4.1 percent for <strong>2011</strong>, subject to changes in TGI’s allowed return on equity (“ROE”) and<br />

capital structure; and<br />

2. An order pursuant to section 44.2 of the Act approving an expenditure schedule for the<br />

continuation in <strong>2011</strong> of TGI’s residential and commercial Energy Efficiency and<br />

Conservation ("<strong>EEC</strong>") funding, as well as new <strong>EEC</strong> funding for <strong>2010</strong> and <strong>2011</strong> for<br />

interruptible industrial programs and innovative technologies; and<br />

3. New tariff offerings and economic tests for Compression and Refuelling and<br />

Transportation Services for Natural Gas Vehicles ("NGV"), geo-exchange, solar<br />

thermal and district energy systems and a pilot program for Biogas; and<br />

C. A complete listing of the relief sought by TGI in the Application was included in Section D<br />

(pages 513-516) 1 of the Application; and<br />

D. In accordance with Commission Order No. G-76-09 issued on June 19, 2009, a Workshop<br />

was held on July 6, 2009 for a review of the Application, a procedural conference was<br />

held on July 15, 2009, and TGI responded to two rounds of Information Requests; and<br />

E. In accordance with Commission Order No. G-89-09 issued on July 20, 2009, a second<br />

procedural conference was held on September 25, 2009; and<br />
