Terasen Gas Revenue Requirements Application‐<strong>2010</strong>/<strong>2011</strong><br />

Negotiated Settlement<br />

I write on behalf of Teck Coal.<br />

Teck Coal participated in the Negotiated Settlement Process<br />

("NSP"),facilitated by the Staff of the British Columbia Utilities<br />

Commission, and held in the offices of the Commission ,which commenced on<br />

October 21,2009.<br />

Teck Coal in the negotiations took into consideration the 7 "Issues of<br />

Particular Concern to the Commission Panel ",as provided by the Commission<br />

Panel at the commencement of the negotiation.<br />

Issue Number 5 stated " <strong>2010</strong> Rate Changes‐ in the event that a <strong>2010</strong> rate<br />

reduction were to occur as a result of the negotiations ,the current rates<br />

should remain unchanged and place the revenue surplus into a deferred<br />

account to apply against <strong>2011</strong> and future rate increases with a phase in<br />

amortization that strives for rate stability"<br />

Teck Coal supports the Negotiated Settlement Agreement Package ("TGI NSP<br />

Agreement Package ") dated and circulated by Terasen Gas Inc incorporating a<br />

decrease of (1.73% ) in the Fiscal Year commencing January 1,<strong>2010</strong>,previously<br />

an increase of 5.3%.and an increase of 3.93% in the Fiscal Year Commencing<br />

January 1,<strong>2011</strong>,previously an increase of 4.1% .<br />

The Negotiated Settlement Agreement Package, incorporates ,amongst<br />

others,Issues of Particular Concern to the Commission Panel No. 5<br />
