(3) If an agreement holder referred to in subsection (1)<br />

notifies the minister that the agreement holder has not<br />

abandoned and does not intend to abandon the rights referred<br />

to in subsection (1), the minister may order the agreement<br />

holder not to destroy the Crown timber referred to in that<br />

subsection, if the minister is satisfied that a market exists for<br />

that Crown timber.<br />

(4) A person to whom an order under this section has been<br />

given must comply with the order.<br />

Freedom of Information and Protection of Privacy Act<br />

52 Schedule 2 of the Freedom of Information and Protection of<br />

Privacy Act, R.S.B.C. 1996, c. 165, is amended by striking out the<br />

following:<br />

Public Body: British Columbia Transmission Corporation<br />

Head: Chair .<br />

Hydro and Power Authority Act<br />

53 Section 1 of the Hydro and Power Authority Act, R.S.B.C. 1996,<br />

c. 212, is amended in the definition of "power" by adding ", except<br />

in sections 12 (1) and 38 (2)," before "includes energy".<br />

54 Section 12 (1) is repealed and the following substituted:<br />

(1) Subject to this Act and the regulations, the authority has<br />

the capacity and the rights, powers and privileges of an<br />

individual of full capacity and, in addition, has<br />

(a) the power to amalgamate in any manner with a<br />

firm or person, and<br />

(b) any other power prescribed.
