The subject site is entitled to a number of concessions in accordance with Planning Policy
6.7 Parking in view of its location to the Main Street car park on the corner of Main and
Royal Streets (10%), and the premises falling within a ‘Strip’ Commercial Centre (10%).
With the concessions applied (totalling 20%), the parking requirement for the development is
reduced to 40.8 (41) car bays from 51 car bays. The resultant car parking shortfall is 25
bays.
The parking requirements for most of the land uses are considered excessive given the
nature of the business. The music academy for example is classified under the generic land
use classification of ‘Educational Establishment’. This use class is normally applicable to
schools and tertiary institutions where students occupy a number of rooms or classrooms at
the one (1) time, and not the one (1) on one (1) style of tuition provided by the music
academy. Similarly the requirement for six (6) parking bays per Health Consultant is
considered slightly onerous in this instance as there will be a maximum of four (4) persons
on the premises at any one (1) time (i.e. one (1) podiatrist, one (1) receptionist and one (1)
or two (2) patients).
The video store falls under the use class activity of ‘Shop’. However, it does not tend to
operate like a traditional shop in that customers only stay for a short period of time to choose
a DVD, thereby having very little affect on parking demand.
Planning Policy 6.7 Parking prescribes reciprocal parking as a consideration in varying the
parking standards. Some of the various unauthorised uses have differing hours of operation.
This commercial strip accommodates uses where parking does not reasonably coincide, or
the peak hours of operation do not substantially conflict. For example, the Music Academy
does not open until 2.30pm, with classes commencing at 3.30pm. Most of the other
businesses are closing shortly after this time. It is also noted that the property would be
reasonably quiet in terms of parking and traffic on Sundays as the Barber, Podiatrist and
Music Academy are closed.
