Officer's Recommendation That the information report on Planning and Development matters to which the City is a respondent currently listed at the State Administrative Tribunal be RECEIVED. Report Purpose To Provide an update report on Planning and Development matters currently listed in the State Administrative Tribunal (SAT). Relevant Documents Attachments Attachment 1 - Monthly listing of Planning and Development matters at SAT Available for viewing at the meeting Nil. Background At the Council meeting held 15 April 2008, Council resolved (Council Resolution Number 0408/055):- “That the State Administrative Tribunal hearings affecting the City of Stirling planning or in relation to planning issues be LISTED monthly on the agenda for information only” Comment The current listing of Planning and Development matters where the City is a respondent at the SAT is attached. The following information is listed:- 1. Details of the Matter; 2. Representation; 3. Reference – address and development description; and 4. Status or Outcome. This listing is provided for information purposes. Matters which are currently in mediation at the SAT are required to be treated as confidential in accordance with the requirements of the State Administrative Tribunal Act 2004. 344
MINUTES OF THE ORDINARY MEETING OF COUNCIL 18 SEPTEMBER 2012 Additionally, in accordance with the Council’s adopted procedure for dealing with SAT Appeals, it is common for the City to appoint legal representation and seek legal advice. Legal advice sought on these matters is subject to legal professional privilege and must also be treated as confidential. Where a Council decision is required in respect to the conduct of a specific matter, a separate detailed report will be provided to Committee and Council. Consultation/Communication Implications Nil. Policy and Legislative Implications The City is required to respond to matters listed in the SAT in accordance with the requirements of the State Administrative Tribunal Act 2004. Additionally, the Council has an adopted procedure for dealing with SAT matters. Financial Implications Nil. Strategic Implications Nil.
