Development Standards Local Planning Scheme No.3 Under LPS3, the objectives of the Industry zone are defined as:- "a. provide for a range of industrial and business development, as well as facilities for the storage and distribution of goods. b. To ensure a high standard of development appropriate to a modern industrial area and which is conducive to safe and convenient access by all clientele.” 228
MINUTES OF THE ORDINARY MEETING OF COUNCIL 18 SEPTEMBER 2012 Under LPS3 Industry General is defined as:- “means an industry other than a cottage, extractive, light, mining, noxious, rural or service industry.” Restaurant is a discretionary (D) use, meaning that the use is not permitted unless the Council has exercised its discretion by granting planning approval. Under LPS3 Restaurant is defined as:- “premises were the predominant use is the sale and consumption of food and drinks on the premises and where seating is provided for patrons, and includes a restaurant licenced under the Liquor Licencing Act 1988.” Restaurant is a discretionary (D) use, meaning that the use is not permitted unless the Council has exercised its discretion by granting planning approval. It should be noted that the City considers a ‘café’ as a Restaurant land use, as defined by LPS3. Other Policies Local Planning Policy 4.3 - Industrial Design Guidelines The Industrial Design Guidelines provide the following statement in respect of the Osborne precinct:- The Osborne Precinct is all the remaining industrial land not contained within any of the above (Balcatta, Herdsman or Stephenson) precincts. This area is designed to allow for a broad range of large scale and small scale industrial uses on a variety of lot sizes. In the short term, large scale offices shall be permitted within 500m of Glendalough Train Station. Local Planning Policy 6.7- Parking Parking for the uses on site is required to be provided at the following rate:- Industry General – one (1) bay per 50m 2 gross floor area; and Restaurant – one (1) bay per 7m 2 gross floor area. Development on the site is permitted a 5% parking concession as five (5) bicycle parking bays in excess of the required number are proposed as permitted by the City’s Parking Policy. The Parking Policy allows for the provision of cash-in-lieu of parking bays in instances where non-residential developments are unable to meet the Scheme parking requirements. Variations to the City’s Parking Policy need to be considered against the objectives of the policy. These are:- To facilitate the development of adequate parking facilities; To ensure safe, convenient and efficient access for pedestrians, cyclists and motorists; To ensure that a major parking problem is unlikely to occur; 229
