Whilst it is acknowledged that some loss of views of significance may be experienced by the
dwellings to the rear of the property towards the Mt Flora Regional Museum, these are no
greater than that which would be lost as a result of a dwelling with a compliant building
height.
The submission received from the adjoining property owner has been taken into
consideration when assessing this application however; it cannot be substantiated on
planning grounds.
Policy and Legislative Implications
Should the Council refuse the application for development approval, the applicant may have
the right to have the decision reviewed in accordance with Part 14 of the Planning and
Development Act 2005.
