委 員 會 的 工 作
審 查 貪 污 舉 報 諮 詢 委 員 會 於 二
零 零 六 年 召 開 了 八 次 會 議 , 審 議 由 執 行
處 擬 備 的 報 告 。 在 每 次 會 議 上 , 執 行 處
向 委 員 會 報 告 的 事 項 包 括 主 要 案 件 的 進
度 、 廉 署 調 查 時 間 超 過 一 年 的 個 案 、 連
續 受 廉 署 保 釋 達 六 個 月 以 上 的 人 士 , 以
及 廉 政 專 員 根 據 《 防 止 賄 賂 條 例 》 第 17
條 授 權 而 批 准 進 行 的 搜 查 行 動 。 在 二 零
零 六 年 , 廉 政 專 員 未 有 行 使 這 項 權 力 簽
發 搜 查 令 。 年 內 , 委 員 會 共 聽 取 了 203 宗
檢 控 個 案 的 報 告 , 並 曾 審 議 46 宗 未 有 提
出 檢 控 的 主 要 案 件 。
執 行 處 首 長 出 席 委 員 會 每 次 會
議 , 向 各 委 員 匯 報 執 行 處 的 工 作 概 況 、
貪 污 舉 報 統 計 數 字 及 貪 污 趨 勢 、 行 動 聯
絡 事 宜 , 以 及 委 員 會 關 注 的 其 他 事 項 。
廉 署 亦 就 其 關 注 的 重 要 事 項 , 向 委 員 會
提 交 討 論 及 參 考 文 件 , 當 中 包 括 :「 公
務 員 貪 污 及 舞 弊 行 為 年 報 」、 轉 介 調 查
事 宜 相 關 文 件 予 政 府 部 門 和 私 營 機 構 的
機 制 、 向 有 關 政 府 部 門 和 其 他 監 管 組 織
或 機 構 披 露 委 員 會 報 告 內 資 料 的 處 理 方
法 、 知 會 案 件 調 查 結 果 的 程 序 、 以 及 普
Sir,
I present my report on the work of the
Independent Commission Against Corruption
(ICAC) Operations Review Committee (ORC) for
the year 2006.
TERMS OF REFERENCE AND MEMBERSHIP
The terms of reference and membership
of the Committee are at Annexes A and B
respectively. A new member, Ms Ann CHIANG
Lai-wan joined the Committee in January 2006.
WORK OF THE COMMITTEE
The Committee met on eight occasions
during 2006 to review reports prepared by the
Operations Department. At each meeting,
the Committee received progress reports on
current major investigations, cases that had been
investigated by the ICAC for over 12 months,
reports on persons who had been on ICAC bail for
over six months, and searches authorised by the
Commissioner under section 17 of the Prevention
of Bribery Ordinance (POBO). No search warrant
was issued by the Commissioner in 2006. During
the year, the Committee also received 203 reports
on cases prosecuted at court and considered 46
major investigations which had not resulted in
prosecution.
The Head of Operations attended the
meetings of the Committee to brief members
on the work of the Operations Department,
corruption statistics and trends, operational liaison
matters and other issues of interest. We also
received discussion and information papers on
important issues of concern to the Commission,
including the Annual Report on Corruption and
Malpractice in the Civil Service, the system of
referral of documents to government departments
and private organisations, the control of data
contained in ORC reports disclosed to government
departments or other regulatory bodies or
organisations, the procedures of notification
