推 出 一 項 自 願 退 還 牌 照 計 劃 。 按 計 劃
規 定 , 豬 農 若 自 動 退 還 牌 照 , 便 可 按
既 定 程 式 獲 發 特 惠 補 助 金 。 生 豬 運 輸
商 亦 會 獲 得 貸 款 , 以 協 助 他 們 改 裝 車
輛 以 從 事 其 他 業 務 ; 至 於 豬 農 和 運 輸
商 僱 員 , 則 有 資 格 領 取 18,000 元 的 一 筆
過 補 助 金 。 防 貪 處 建 議 漁 護 署 應 清 楚
訂 明 獲 發 特 惠 補 助 金 的 資 格 , 並 規 定
巡 視 人 員 須 拍 攝 豬 場 的 照 片 , 作 核 對
用 途 。 此 外 , 防 貪 處 亦 建 議 漁 護 署 應
規 定 督 導 人 員 抽 查 個 案 , 並 在 牌 照 取

旅 行 社 營 運 管 理 防 貪 錦 囊
防 貪 處 與 香 港 旅 遊 業 議 會 合 作 ,
編 訂 了 一 冊 關 於 旅 行 社 營 運 管 理 的 防
貪 錦 囊 , 以 協 助 旅 行 社 以 合 乎 誠 信 原
則 的 方 法 提 供 旅 遊 服 務 , 並 於 營 運 程
序 中 設 置 防 貪 措 施 。 錦 囊 內 容 涵 蓋 旅
行 社 的 主 要 營 運 程 序 , 包 括 外 遊 團 的
銷 售 安 排 、 為 入 境 團 旅 客 提 供 接 待 服
務 、 及 酒 店 房 間 及 機 位 預 訂 服 務 等 。
於 二 零 零 六 年 九 月 , 防 貪 處 亦 與 約 有
1,400 名 會 員 的 香 港 旅 遊 業 議 會 合 辦 工
作 坊 , 向 旅 遊 業 人 士 推 廣 該 份 防 貪 錦
囊 , 以 提 高 業 界 的 防 貪 意 識 。
律 政 司 - 刑 事 檢 控 科 的 外 判 程 序
基 於 多 種 原 因 , 如 沒 有 合 適 的
政 府 律 師 , 律 政 司 會 把 各 級 法 院 約 六
分 一 的 審 訊 案 件 , 外 判 予 私 人 執 業 大
律 師 和 律 師 進 行 檢 控 。 這 些 案 件 大 部
分 會 按 標 準 費 用 外 判 。 律 政 司 刑 事 檢

and introduce a performance appraisal system
to facilitate contract renewals and promotions.
We also advised ESF to issue instructions on
managing conflict of interest covering both staff
and members of its Executive Committee and
School Councils. With regard to the procurement
of supplies and services and the award of works
contracts, we recommended that ESF should
segregate the core duties of the process and
keep central lists of suppliers and contractors
for invitation to bid by rotation. As for student
admission, we recommended that ESF should
lay down objective criteria for determining the
order of inviting applicants for interview, maintain
detailed records of admission interviews, and issue
staff instructions on managing conflict of interest in
student admission matters.
Estate Agents Authority (EAA) – Licensing
Procedures
EAA regulates persons carrying out estate
agency activities in Hong Kong through a licensing
system. Persons applying for a licence must
meet the licensing criteria, including passing a
qualifying examination and meeting the "fit and
proper" requirement. While EAA sets questions
for the qualifying examinations, the Hong Kong
Examinations and Assessment Authority conducts
the examinations on its behalf. EAA has also
appointed a few external legal practitioners
to set examination questions. In 2005/06,
EAA processed a total of 6,900 new licence
applications and 19,635 renewal applications.
The study noted that there is incentive for
ineligible applicants to obtain a licence through
corrupt means. We recommended that EAA
should conduct random checks with the Hong
Kong Police Force on the "fit and proper" status
of the applicants to deter false declaration. In the
selection of legal practitioners for question setting,
we recommended that EAA should lay down the
selection criteria. We also recommended that
EAA should computerise the question bank to
facilitate the compilation of question papers, and
enhance security safeguards in the handling of the
question papers and examination results.
