(a) 接 受 及 考 慮 有 關 指 稱 貪 污 行 為 的 投
訴 , 並 在 其 認 為 切 實 可 行 的 範 圍 內
就 該 等 投 訴 進 行 調 查 ;
(b) 調 查 -
RESPONSIBILITIES OF THE COMMISSIONER
The Commissioner is directly responsible
to the Chief Executive for the following duties set
out in section 12 of the Independent Commission
Against Corruption Ordinance :
(i)
任 何 涉 嫌 或 被 指 稱 是 犯 《 廉
政 公 署 條 例 》 所 訂 的 罪 行 ;
(a)
to receive and consider complaints alleging
corrupt practices and investigate such of
those complaints as he considers practicable;
(ii)
任 何 涉 嫌 或 被 指 稱 是 犯 《 防
止 賄 賂 條 例 》( 第 201 章 ) 所
訂 的 罪 行 ;
(b) to investigate -
(i)
any alleged or suspected offence under
this Ordinance;
(iii) 任 何 涉 嫌 或 被 指 稱 是 犯 《 選
舉 ( 舞 弊 及 非 法 行 為 ) 條 例 》
( 第 554 章 ) 所 訂 的 罪 行 ;
(ii)
any alleged or suspected offence under
the Prevention of Bribery Ordinance
(Cap. 201);
(iv) 任 何 涉 嫌 或 被 指 稱 是 由 香 港
特 別 行 政 區 政 府 僱 員 藉 著 或
通 過 不 當 使 用 職 權 而 犯 的 勒
索 罪 ;
( v ) 任 何 涉 嫌 或 被 指 稱 是 串 謀 犯
《 防 止 賄 賂 條 例 》 ( 第 2 0 1
章 ) 所 訂 的 罪 行 ;
(vi) 任 何 涉 嫌 或 被 指 稱 是 串 謀 犯
《 選 舉 ( 舞 弊 及 非 法 行 為 ) 條
例 》 ( 第 5 5 4 章 ) 所 訂 的 罪
行 ; 及
(vii) 任 何 涉 嫌 或 被 指 稱 是 ( 由 2 人
或 多 於 2 人 , 其 中 包 括 香 港 特
別 行 政 區 政 府 僱 員 ) 串 謀 藉
著 或 通 過 該 名 香 港 特 別 行 政
區 政 府 僱 員 不 當 使 用 職 權 而
犯 的 勒 索 罪 ;
(c) 對 廉 政 專 員 認 為 與 貪 污 有 關 連 或 助
長 貪 污 的 香 港 特 別 行 政 區 政 府 僱 員
行 為 進 行 調 查 , 並 就 此 事 向 行 政 長
官 報 告 ;

any alleged or suspected offence
under the Elections (Corrupt and Illegal
Conduct) Ordinance (Cap. 554);
any alleged or suspected offence
o f b l a c k m a i l c o m m i t t e d b y a
Government of the Hong Kong Special
Administrative Region (HKSAR) servant
by or through the misuse of his office;
any alleged or suspected conspiracy
to commit an of fence under the
Prevention of Bribery Ordinance (Cap.
201);
any alleged or suspected conspiracy
to commit an of fence under the
Elections (Corrupt and Illegal Conduct)
Ordinance (Cap. 554); and
any alleged or suspected conspiracy
(by two or more persons including
a Government of HKSAR servant) to
commit an offence of blackmail by or
through the misuse of the office of that
Government of HKSAR servant;
to investigate any conduct of a Government
of HKSAR servant which, in the opinion
of the Commissioner, is connected with or
conducive to corrupt practices and to report
thereon to the Chief Executive;
