很 高 興 得 悉 , 自 公 務 員 紀 律 秘 書 處 於 二
零 零 零 年 成 立 以 來 , 政 府 處 理 紀 律 處 分
個 案 的 效 率 已 見 改 善 。 大 部 分 ( 約 八 成 ) 紀
律 個 案 的 處 理 時 間 有 所 縮 短 , 需 要 進 行
紀 律 聆 訊 的 個 案 由 7 至 18 個 月 減 為 3 至 9 個
月 , 而 無 需 進 行 聆 訊 的 則 由 1 至 9 個 月 減
為 1 至 3 個 月 。
涉 及 私 營 機 構 的 貪 污 舉 報
二 零 零 六 年 的 整 體 貪 污 舉 報 總
數 中 , 涉 及 私 營 機 構 的 投 訴 仍 佔 較 大 比
重 , 共 61% 或 2,037 宗 , 較 二 零 零 五 年 的
2,247 宗 減 少 9%。 其 中 可 追 查 的 舉 報 較 二
零 零 五 年 減 少 7%( 由 1,868 宗 減 至 1,731
宗 )。 與 往 年 一 樣 , 樓 宇 管 理 及 金 融 保
險 業 仍 是 私 營 機 構 中 最 受 關 注 的 界 別 。
其 中 涉 及 樓 宇 管 理 的 舉 報 最 多 , 共 822
宗 , 佔 私 營 機 構 整 體 舉 報 數 字 的 40%。
大 部 分 舉 報 屬 輕 微 性 質 , 可 交 由 執 行 處
的 「 快 速 反 應 隊 」 迅 速 處 理 。 但 委 員 會
留 意 到 , 有 個 別 案 件 涉 及 集 團 式 貪 污 的
情 況 , 牽 涉 判 授 維 修 合 約 和 業 主 立 案 法
團 , 尤 其 是 關 於 後 者 在 資 金 管 理 和 判 授
合 約 方 面 的 運 作 。
金 融 保 險 業 是 被 檢 控 人 數 最 高
的 界 別 , 共 有 51 人 因 觸 犯 《 防 止 賄 賂 條
例 》 第 9 條 及 其 他 相 關 罪 行 而 被 檢 控 , 較
二 零 零 五 年 的 28 人 上 升 82%。 我 們 知 道 有

ACTION BY HEADS OF DEPARTMENTS
In 2006, on recommendation of the
Committee, 75 cases involving 150 government
servants were referred to the relevant heads of
departments for consideration of disciplinary
or administrative action, a decrease of 12%
in the number of persons over 2005. These
referrals related to, among others, the acceptance
of unauthorised loans, misuse of authority,
negligence of duty, acceptance of gifts and
entertainment, and undesirable association.

Department continues to assist government
departments to strengthen their systems to
minimise corruption opportunities, there were
cases that revealed individual government
servants, especially those involved in the
procurement and services contracts, had made
use of their positions or sought ways to circumvent
departmental rules for personal gain. Over the
years, the Committee noticed incidences of
public officials misconducting themselves through
abuse of their office. We were also aware of the
legislative constraints imposed on the ICAC in
investigating the Common Law offence of MIPO.
The Committee urges the government to expedite
the necessary legislative amendments so that
investigation and prosecution into misconduct
allegedly committed by public officials could
be more effective. Members also urge the
government to reinforce measures to promote a
more effective culture of integrity, in particular,
supervisory accountability, to address the
problem.
Th e C o m m i t t e e a l s o m o n i t o r s a ny
follow-up disciplinary actions undertaken by
government departments. The Committee is
pleased to note that the processing time of dealing
with disciplinary cases by the Administration
has improved since the establishment of the
Secretariat on Civil Service Discipline in 2000.
The processing time of the majority (about 80%)
of disciplinary cases has been shortened from
7-18 months to 3-9 months for cases which
require a hearing and from 1-9 months to 1-3
months for cases which do not require a hearing.
