政 府 律 師 擬 定 初 選 律 師 名 單 , 並 邀 請
他 們 報 價 。 刑 事 檢 控 專 員 會 按 照 其 擔
任 主 席 的 刑 事 檢 控 科 遴 選 委 員 會 的 意
見 , 訂 定 案 件 的 聘 用 條 款 ; 而 廉 政 公
署 亦 會 派 代 表 以 觀 察 員 身 分 列 席 委 員
會 會 議 。 在 二 零 零 四 至 零 五 年 度 , 律
政 司 以 標 準 費 用 外 判 案 件 的 金 額 達
3,270 萬 元 , 而 非 標 準 費 用 外 判 案 件 的
金 額 則 為 1,060 萬 元 。
為 改 善 外 判 律 師 名 冊 的 管 理 ,
防 貪 處 建 議 律 政 司 應 檢 討 其 「 外 判 手
冊 」, 以 及 將 輪 流 選 擇 外 判 律 師 的 系
統 電 腦 化 。 該 處 亦 建 議 律 政 司 提 醒 政
府 律 師 須 依 照 規 定 , 在 提 交 遴 選 委 員
會 的 建 議 中 , 交 代 從 初 選 名 單 上 選 擇
個 別 律 師 的 原 因 , 以 及 詳 細 記 錄 聘 用
非 最 低 報 價 者 的 理 由 。

校 的 財 務 管 理 手 冊 及 相 關 研 討 會
根 據 2 0 0 4 《 教 育 ( 修 訂 ) 條
例 》 規 定 , 所 有 資 助 學 校 必 須 於 二 零
零 九 年 或 之 前 成 立 法 團 校 董 會 , 以 管
理 校 政 。 設 有 法 團 校 董 會 的 學 校 在 運
用 政 府 資 助 上 , 可 享 有 更 大 的 自 主 權
和 靈 活 性 。 於 二 零 零 六 年 六 月 , 教 統
局 委 任 財 務 顧 問 , 為 這 些 學 校 制 訂 財
務 管 理 手 冊 。 防 貪 處 向 教 統 局 建 議 ,
手 冊 應 提 醒 法 團 校 董 會 恪 守 誠 信 規
條 , 特 別 須 要 避 免 及 申 報 利 益 衝 突 。
法 團 校 董 會 學 校 也 應 進 行 內 部 審 計 ,
確 保 其 運 作 符 合 恰 當 程 序 , 以 及 妥 善
記 錄 學 校 接 受 的 捐 贈 , 如 因 特 別 情 況
須 接 受 供 應 商 和 教 科 書 出 版 商 捐 贈 ,
應 交 代 理 由 。

Agriculture, Fisheries and Conservation
Department (AFCD) – Voluntary Surrender
Scheme for Pig Farmers, Live Pig Transporters
and their Workers
To reduce the number of pig farms in
the territory thereby reducing the associated
public health and pollution problems, AFCD
has introduced a voluntary surrender scheme
for pig farmers. Under the scheme, ex-gratia
compensation calculated according to a fixed
formula is paid to pig farmers who voluntarily
surrender their licences. Loans are also given to
the pig transporters to enable them to convert
their vehicles for other business use. Further,
the workers hired by the live pig farmers and
transporters are eligible for a one-off grant of
$18,000. We recommended that AFCD should
clearly define the eligibility criteria for the ex-gratia
compensation and require the field officers to take
photographs on the farm structures for verification
purpose. We further advised AFCD to require
supervisory staff to conduct spot checks and
arrange re-inspections on the pig farms after the
cancellation of the licences.
Best Practice Module for Travel Agents
Together with the Travel Industry Council
of Hong Kong (TIC), we produced a Best Practice
Module on the travel agents' operations with
the aim of assisting travel agents to adopt ethical
practices in the delivery of travel services and
to build in corruption prevention safeguards in
their operational procedures. The Module covers
the core operations of a travel agent such as the
sale of outbound package tours, the provision
of "reception" service to inbound visitors, and
the booking of hotel rooms and air passages.
We jointly organised with TIC, which has a
membership of about 1,400 licensed travel agents,
a training workshop in September 2006 to launch
the Module and to raise corruption prevention
awareness among the industry practitioners.
Department of Justice (DoJ) – Prosecutions
Division Briefing Out Procedures
For various reasons, such as unavailability
of suitable in-house counsel, DoJ briefs out
about one-sixth of its trial cases at all levels of
court to barristers and solicitors on fiat. Most fiat
cases are briefed out at standard fee rates. The
