The study noted that the procedures
adopted by the contractors for the collection and
distribution of the donated items were prone to
abuse, such as pilferage by the staff involved.
We recommended that EPD should
critically review t he cont rac t sco p e and
requirements to ensure that they are realistic
and enforceable. Also, EPD should select the
contractors through an open and competitive
bidding process. We further recommended
that EPD should closely guide and monitor the
contractors in the setting up of a proper control
mechanism.
Food and Environmental Hygiene Department
(FEHD) – Work of Hawker Control Teams
(HCT)
Hawkers have a long history in Hong
Kong and their operations often cause nuisance
and environmental hygiene problems. Any
person who hawks in a public place must have a
licence from FEHD. To enforce against unlicensed
hawking activities, FEHD has established HCTs in
its 19 District Environmental Hygiene Offices for
patrol and raiding duties, and a regional Hawker
Control Task Force at each of the three FEHD
Operations Divisions to conduct independent
raiding operations. Following a number of
corruption allegations relating to hawker control in
recent years, we reviewed the work procedures of
HCT.
The study noted that hawkers obstructing
public places were warned verbally before
prosecution but disputes often occurred over
whether a verbal warning had been properly
given. For effective enforcement of the verbal
warning system, we recommended that FEHD
should formalise the verbal warning statement and
develop an information system for recording and
retrieval of the warnings administered. To reduce
the chance of "tipping off" impending operations,
we recommended that raiding targets should
only be revealed to the raiding squads at the last
practical moment. We further recommended that
officers should be required to justify the selection
of raiding targets to avoid allegations of favouritism
in taking enforcement actions.
