建 造 業 工 人 註 冊 管 理 局 ( 建 管 局 )- 建
造 業 工 人 註 冊 制 度
建 管 局 乃 根 據 《 建 造 業 工 人 註
冊 條 例 》 而 成 立 , 為 全 港 約 16 萬 名 建
造 業 工 人 進 行 註 冊 , 並 於 二 零 零 五 年
十 二 月 二 十 九 日 起 實 施 註 冊 計 劃 。 待 註
冊 計 劃 完 成 後 , 政 府 會 宣 佈 條 例 的 正 式
生 效 日 期 , 此 後 只 有 註 冊 工 人 方 可 在 地
盤 工 作 。 根 據 該 計 劃 的 規 定 , 持 有 有 效
安 全 訓 練 課 程 證 書 的 建 造 業 工 人 可 註 冊
成 為 普 通 工 人 ; 擁 有 其 他 資 歷 或 工 作 經
驗 者 則 可 在 相 關 行 業 註 冊 成 為 半 熟 練 或
熟 練 技 工 。
研 究 指 出 , 建 管 局 在 審 核 申 請 人
的 安 全 訓 練 課 程 證 書 時 往 往 出 現 延 誤 ,
只 有 六 成 的 註 冊 申 請 能 夠 在 承 諾 的 14
個 工 作 天 內 完 成 批 核 。 冗 長 的 批 核 過 程
不 但 影 響 工 人 在 法 例 生 效 後 的 就 業 機
會 , 也 可 能 令 急 於 覓 得 工 作 的 工 人 , 不
惜 行 賄 有 關 人 員 , 以 加 快 註 冊 過 程 。 有
見 及 此 , 防 貪 處 建 議 建 管 局 應 連 接 勞 工
處 的 安 全 訓 練 課 程 電 腦 資 料 庫 , 以 加 快
審 核 申 請 人 身 份 的 程 序 ; 亦 應 定 期 編 印
處 理 申 請 的 進 度 報 告 , 以 便 管 理 層 進 行
監 察 。 此 外 , 防 貪 處 亦 建 議 建 管 局 公 佈
申 請 被 拒 絕 的 覆 檢 渠 道 。
英 基 學 校 協 會 ( 英 基 )- 工 作 程 序 研 究
英 基 是 專 為 選 擇 接 受 英 語 教 學 的
學 生 提 供 教 育 的 法 定 團 體 , 轄 下 共 有
20 所 學 校 共 12,000 多 名 學 生 。 政 府 每 年
撥 款 約 2 億 8,000 萬 元 資 助 英 基 部 份 的 經
費 。 繼 傳 媒 於 二 零 零 四 年 初 報 道 其 財
務 管 理 不 善 和 員 工 招 聘 出 現 偏 私 的 情 況
後 , 防 貪 處 為 英 基 進 行 了 四 項 審 查 研
究 , 範 圍 包 括 人 事 管 理 、 一 般 採 購 及 工
程 和 清 潔 / 保 安 合 約 的 招 標 程 序 。 此
外 , 防 貪 處 亦 對 英 基 的 收 生 程 序 提 供 了
諮 詢 服 務 。

and a PSL holder has to obtain TD's approval
before operating any one of them. Some NFB
service providers operate without a PSL while
others have gone beyond the authorised scope of
operation. Under the Road Traffic Ordinance, the
Commissioner for Transport may cancel, suspend
or vary a PSL if upon an investigation and an
inquiry, the PSL holder is found to have breached
the PSL conditions. If the PSL holder does not
accept the Commissioner's decision, he may apply
for a review by a Transport Tribunal. He may
further apply for a judicial review of the Tribunal's
decision.
The study noted that there is incentive for
a PSL holder to resort to corrupt means to delay
as much as possible the inquiry process and to
influence the TD officer handling the matter so
that actions taken are to his favour. The study also
observed that the investigation and inquiry process
takes a long time to complete due to procedural
requirements and limited manpower resources.
The PSL holder may, during that time, continue to
generate profit from the unauthorised service. We
therefore recommended that TD should streamline
the process, lay down internal time limits for the
various stages of the course of action, and appoint
more Transport Tribunals to shorten the waiting
time for review cases.

Construction Workers Registration Ordinance
(the Ordinance) for the registration of over
160,000 construction workers in Hong Kong. The
registration scheme started on 29 December 2005.
Upon completion of the registration exercise,
the Ordinance will come into effect on a date
to be announced, after which only registered
workers can work on a construction site. Under
the scheme, construction workers with a valid
site safety certificate may be registered as general
workers and those with additional qualifications or
working experience can register as semi-skilled or
skilled workers in the relevant trade.
