Corruption Prevention Department<br />
防 止 貪 污 處 ( 防 貪 處 ) 的 主 要 任<br />
務 , 是 減 少 政 府 部 門 及 公 共 機 構 工 作 程<br />
序 及 常 規 中 的 貪 污 風 險 。 該 處 的 工 作 方<br />
法 , 主 要 是 透 過 審 查 部 門 及 機 構 的 工 作<br />
程 序 , 以 確 保 容 易 出 現 貪 污 的 公 共 政 策<br />
及 工 作 方 法 得 以 改 善 。 防 貪 處 致 力 與<br />
政 府 部 門 及 公 共 機 構 建 立 伙 伴 關 係 , 一<br />
同 訂 定 需 要 進 行 檢 討 的 工 作 範 疇 ( 稱 為<br />
「 審 查 研 究 」), 並 監 察 它 們 落 實 防 貪<br />
建 議 的 情 況 。 防 貪 處 的 另 一 法 定 職 責 是<br />
應 私 營 機 構 的 要 求 , 提 供 免 費 防 貪 顧 問<br />
服 務 。<br />
組 織 及 編 制<br />
防 貪 處 由 一 名 處 長 及 兩 名 助 理<br />
處 長 領 導 , 轄 下 設 有 五 個 審 查 工 作 組 、<br />
一 個 特 別 項 目 組 、 一 個 私 營 機 構 顧 問 組<br />
及 一 個 管 理 組 。 每 個 審 查 工 作 組 負 責 多<br />
個 政 府 部 門 、 公 共 機 構 及 特 定 職 能 範<br />
圍 , 例 如 公 共 採 購 、 公 共 工 程 、 外 判 工<br />
作 、 公 務 員 誠 信 等 的 防 貪 工 作 ; 特 別 項<br />
目 組 主 動 向 正 在 計 劃 或 巳 經 落 實 推 行 公<br />
營 部 門 與 私 營 機 構 合 作 項 目 的 政 府 決 策<br />
局 和 部 門 , 給 予 防 貪 建 議 ; 私 營 機 構 顧<br />
問 組 會 應 私 營 機 構 的 要 求 提 供 防 貪 諮 詢<br />
服 務 ; 至 於 處 內 的 行 政 支 援 工 作 , 則 由<br />
管 理 組 負 責 。 二 零 零 六 年 年 底 , 防 貪 處<br />
的 在 職 人 數 共 有 56 人 。 他 們 大 部 分 為 專<br />
業 會 計 師 、 工 程 師 、 測 量 師 、 資 訊 科 技<br />
專 才 , 以 及 具 有 豐 富 公 共 行 政 經 驗 的 前<br />
任 公 務 員 。<br />
工 作 回 顧<br />
防 貪 處 於 二 零 零 六 年 內 共 完 成 96<br />
項 審 查 研 究 , 當 中 61 項 關 乎 政 府 部 門<br />
的 工 作 , 另 外 35 項 則 與 公 共 / 其 他 機 構<br />
運 作 有 關 。 審 查 研 究 的 範 圍 包 括 環 境 保<br />
護 、 建 造 工 程 、 公 共 房 屋 、 教 育 、 物 料<br />
及 服 務 採 購 和 執 法 等 。 防 貪 處 在 訂 定 研<br />
究 範 圍 時 的 首 要 考 慮 是 貪 污 風 險 , 並 會<br />
優 先 跟 進 由 貪 污 投 訴 及 調 查 個 案 揭 發 的<br />
The Corruption Prevention Department has<br />
a statutory responsibility to m<strong>in</strong>imise opportunities<br />
for corruption <strong>in</strong>herent <strong>in</strong> the practices and<br />
procedures of government departments and<br />
public bodies. This is achieved primarily through<br />
exam<strong>in</strong><strong>in</strong>g their work procedures, with a view<br />
to secur<strong>in</strong>g revision of public policies and work<br />
methods which are conducive to corruption. In<br />
this process, the Department adopts a partner<strong>in</strong>g<br />
approach with government departments and<br />
public bodies. Together with the "partners", the<br />
Department identifies corruption prone areas<br />
for review (known as assignment studies) and<br />
monitors the implementation of recommended<br />
corruption prevention measures. On request,<br />
the Department also provides free corruption<br />
prevention advisory services to private sector<br />
organisations, as mandated under the law.<br />
STRUCTURE AND ESTABLISHMENT<br />
The Department, headed by a Director<br />
underp<strong>in</strong>ned by two Assistant Directors, is<br />
organised <strong>in</strong>to five Assignment Groups, a Special<br />
Projects Group, an Advisory Services Group<br />
and a Management Group. Each Assignment<br />
Group is responsible for corruption prevention<br />
work <strong>in</strong> a number of government departments<br />
and public bodies, and specialises <strong>in</strong> specific<br />
functional areas such as public procurement,<br />
public works, outsourc<strong>in</strong>g, and civil service<br />
<strong>in</strong>tegrity. The Special Projects Group proactively<br />
advises government bureaux and departments<br />
<strong>in</strong>volved <strong>in</strong> plann<strong>in</strong>g and implement<strong>in</strong>g Public<br />
Private Partnership (PPP) projects on corruption<br />
prevention related matters. The Advisory Services<br />
Group handles requests for corruption prevention<br />
advice from private organisations while the<br />
Management Group provides adm<strong>in</strong>istrative<br />
support to the Department. At the end of<br />
<strong>2006</strong>, the Department had a staff strength of<br />
56. The majority of the officers are professional<br />
accountants, eng<strong>in</strong>eers, surveyors, <strong>in</strong>formation<br />
technology professionals, and former civil servants<br />
with wide experience <strong>in</strong> public adm<strong>in</strong>istration.<br />
REVIEW OF WORK<br />
In <strong>2006</strong>, the Department completed 96<br />
assignment studies, 61 of which were related to the<br />
work of government departments and 35 to that<br />
of public sector / other organisations. The areas<br />
