二 零 零 六 年 有 十 宗 指 稱 廉 署 人
員 觸 犯 刑 事 罪 行 的 案 件 ( 包 括 二 零 零 二
年 及 二 零 零 五 年 各 兩 宗 尚 未 完 結 的 個
案 ), 由 警 方 負 責 調 查 。 當 中 有 三 宗 投
訴 證 實 並 無 事 實 根 據 ; 其 餘 七 宗 尚 在 調
查 中 。
年 內 , 共 有 三 宗 指 稱 廉 署 人 員
涉 及 貪 污 及 相 關 罪 行 的 投 訴 , 由 L 組 調
查 。 年 底 時 , 兩 宗 在 二 零 零 六 年 接 獲 的
個 案 仍 在 調 查 中 。 一 宗 於 二 零 零 五 年 接
獲 的 投 訴 , 證 實 並 無 事 實 根 據 。 一 宗 由
二 零 零 三 年 展 開 調 查 而 尚 未 完 結 的 個
案 , 亦 於 二 零 零 六 年 完 結 。 案 件 涉 及 一
名 前 廉 署 人 員 在 二 零 零 四 年 候 審 期 間 棄
保 潛 逃 , 翌 年 再 次 被 捕 。 她 承 認 多 項 觸
犯 《 防 止 賄 賂 條 例 》 第 9(3) 條 的 控 罪 ,
被 判 入 獄 15 個 月 。 所 有 已 完 結 的 個 案 都
已 提 交 「 審 查 貪 污 舉 報 諮 詢 委 員 會 」 審
議 。
涉 及 廉 署 人 員 的 非 刑 事 投 訴
年 內 , 廉 署 共 處 理 39 宗 涉 及 廉 署
人 員 的 非 刑 事 投 訴 , 投 訴 事 項 包 括 行 為
不 檢 、 舉 止 粗 鹵 、 疏 忽 職 守 、 濫 用 職
權 、 不 准 或 阻 延 與 律 師 接 觸 、 撰 寫 有 欠
準 確 的 錄 影 帶 撮 要 、 阻 延 就 診 的 要 求 、
檢 取 與 調 查 無 關 的 私 人 信 件 、 拒 絕 向 投
訴 人 透 露 調 查 詳 情 , 以 及 拒 絕 致 電 朋 友
的 要 求 等 。
上 述 投 訴 個 案 當 中 , 有 24 宗 是 在
二 零 零 六 年 以 前 接 獲 的 。「 廉 政 公 署 事
宜 投 訴 委 員 會 」 認 為 其 中 兩 宗 有 實 據 支
持 , 兩 宗 部 份 有 實 據 支 持 ,15 宗 無 實 質
證 據 , 一 宗 則 被 撤 銷 。 至 於 其 餘 四 宗 投
訴 , 一 宗 仍 在 調 查 中 , 另 外 三 宗 則 在 等
待 訴 訟 程 序 的 結 果 。

Allegations of Corruption and/or Other Crime
Against ICAC Officers
In 2006, the Police investigated ten cases
(including two cases brought forward from 2002
and two cases from 2005) involving criminal
allegations against ICAC officers. Three complaints
were found to be unsubstantiated and the
remaining seven cases are still under investigation.
During the year, L Group investigated three
cases alleging corruption and related offences
against ICAC officers. Investigation of two cases,
which were received in 2006, is still on-going
by the end of the year. One complaint received
in 2005 was found to be unsubstantiated. One
case which was carried forward from 2003
concerning a former officer who absconded
before commencement of her trial in 2004 but
was re-arrested in 2005 was concluded in 2006.
She pleaded guilty to offences contrary to section
9(3) of the Prevention of Bribery Ordinance and
was sentenced to 15 months' imprisonment. All
the completed cases were duly reported to the
Operations Review Committee.
Non-Criminal Complaints Against ICAC
Officers
D u r i n g t h e y e a r, 39 n o n - c r i m i n a l
complaints against ICAC officers were processed.
They included allegations of misconduct,
rudeness, neglect of duty, abuse of power, denying
and delaying access to legal representation,
preparing an inaccurate video summary, delaying
request for medical treatment, seizing personal
correspondence irrelevant to the enquiry, refusal
to disclose details of the investigation to the
complainant and denying the request for making a
telephone call to a friend.
24 of the complaints processed were
received before 2006. Among these complaints,
the ICAC Complaints Committee found that two
were substantiated, two partially substantiated
and 15 unsubstantiated, and one complaint was
withdrawn. Of the remaining four complaints, one
is still under investigation and three are awaiting the
conclusion of court proceedings.
